When applying for the DTV do they check your immigration status? If you stayed too long in a country and apply for the DTV from that country will that be a problem? Or is it better to just leavet he country you overstayed, go back to your home country or another country and apply for the DTV?

TLDR : Answer Summary
When applying for the Digital Nomad Visa (DTV) in Thailand, the assessment of your immigration status in the country from which you are applying can vary. Generally, Thai foreign missions may not require proof of legal stay for visa applications, but overstaying in your current country can pose risks. For instance, it could raise concerns about your compliance with immigration laws, potentially affecting your DTV application. Experiences shared by commenters suggest that the requirements can depend on the specific regulations of the Thai embassy in the host country. It may be advisable for individuals who have overstayed to leave the country and apply from either their home country or another location to avoid complications.

My friend has overstayed in the US. She is planning on leaving the US. She is deciding if she should go back to her home country or come with my to Thailand via DTV. I just didnt and dont know if it would be better for her to apply after she has left the US. She has her passport from her country and has been working legally in the US since 1988 and pays taxes etc. But just dont want her to get tripped up

The bigger question is HOW do you think to leave the country while being in overstay?

Why not keep your visit a legal visit?

What will happen with your application at the Thai Embassy is the least of your worries

For example in Indonesia i only got e-visa, no stamp and also did a extension. So when i did my dtv i did put my extension to application as a location proof. If it would show expeiered date when i did the dtv , they could think I have left the indonesia or overstaying. So I guess it also depends in what country you doing it.

Depends on the country you are in. For some Thai embassies you have to show legal status in country, which country are you applying via?

If you’re very obviously overstaying in one country when you apply for the DTV it could be used against you since if you’re willing to ignore their immigration law then you may ignore Thai immigration law as well.

That will normally be a matter between you and immigration when you leave the country, not between you and the Thai foreign mission. You'll be asked to prove your current location to apply for a visa under their jurisdiction. They normally don’t require proof of legal stay, but you might risk being asked to upload all your passport pages, including blank ones.
