When should I apply for a one-year visa extension based on marriage in Thailand, and what are the implications for travel?

Jul 24, 2021
3 years ago
I will renew my one year visa extension based on being married to a Thai for the first time. The visa expiry date is 1th of November 2021

1) Is it one month before I can apply for a new visa?

2) When I hand in the application to immigration, will immigration keep my passport under the consideration period?

3) is the consideration period one month?

4) if immigration doesn't keep my passport, can I travel internationally while my application is under consideration as long as I am back on the appointment date?

5) will immigration need to visit me at my house like they did the first time last year? If they do, then of cause I cannot travel?

Hoping the above make sense ๐Ÿค

TLDR : Answer Summary
The post discusses the renewal process for a one-year visa extension in Thailand based on marriage. Key points include the timing of the application (which can vary from 30 to 45 days depending on the immigration office), the status of the passport during the application (often not kept), and considerations for international travel while the application is under review. The discussion suggests it is crucial to communicate with the immigration office to confirm procedures and requirements, especially regarding potential home visits and re-entry permits.

Thanks for all the helpful info. I just wanted to be in good time and prepare for it ๐Ÿ™๐Ÿค

BUT I agree with Ben,
@Tob***
we're FOUR months away from your current stamp expiring,

You should head on over to your immigration office and ASK them how it works when you need to travel and return during the under consideration period so there's no surprises.

Good Luck with it.

Okay, as a general rule <- meaning at MOST immigration offices in the country, there is no problem applying for a yearly extension, getting the under consideration stamp, then applying for a re-entry permit (which is good ONLY for the under consideration period), exiting the country and returning to the country before the date it says you go to the immigration office to get the year extension inked in.

You need to let them know when you apply you're going to be leaving the country (in case they decide to do a home visit) and you need to buy the re-entry permit after you get the under consideration stamp.

I'm going to shut this down, because it's getting nowhere:

1. You're asking about when to apply for an extension of stay that expires in November. We are in July. November is a very long time away.

2. If you're frequently traveling in and out of Thailand, the one year extension of stay based on marriage is probably not for you; get a multiple entry Non-O visa based on marriage to a Thai national instead. The visa is good for one year, you can enter and leave an unlimited amount of times, and on each entry you're stamped for 89 days.

3. Can you leave Thailand on an "under consideration" stamp on a re-entry permit and return? That'll be between you and the immigration office. Talk to them about your plans, and why it's urgent where couldn't be postpone until later.

Each immigration office has their own policy, and it's something you should be asking them.

Thank you.

It would appear that the poster uses Pattaya Immigration, as do I.

4) In February 2020, I applied for a re-entry permit during the 'under consideration' period, and was given it without a question.

Furthermore, I returned to the Family Visa Extension section, explained the reason for my return, and she extended the consideration period to two months.

@Harry *******
okay, sounds good, so when you applied, there were two months to your pickup appointment day, and you could travel under the consideration time? Correct?

@Tobias ***************
That was my experience.

But I explained to the family lady about my particular circumstance, and she changed the collection date to one a month later..

Thanks, but if I apply one month before, I don't need a re-entry, do I? As I already have a re-entry stamp in my passport valid for 1st November 2021, or will my old visa be invalid as soon as I apply for a new extension?

In case it's not possible or recommended to travel under consideration is then the last day I can apply for an extension on the expiry day of my existing visa the 1st of November 2021

>or will my old visa be invalid as soon as I apply for a new extension?

Your old re-entry permit would become invalid as soon as you apply for a new visa. You will be given an "under consideration" stamp, which can be thought of like a "temporary extension of stay".

okay, I see ๐Ÿ™

if you travel every month, you don't need a yearly extension. You will have every year a under consideration time where you can't travel. In Chiang Mai it will be 4 to 6 weeks under consideration.

precisely I have been in Thailand 7 years without a visa as I travel all the time, but then covid came along, and I had to go for the extension base on married to a Thai as I did not want to be stressed about being on amnesty extension (or whatever its called now) ๐Ÿค

if you really do need to travel in October then my advice would be to put all your documentation together for your application (minus the bank statement and letter that can only be done on the day of application). At the same time make an appointment for after your planned return date but before 1st November.

You can then enjoy your travels with only your bank statement and letter to do on the day.

If you are going to be leaving it until the very last minute it will be worth clarifying if you need Thai referees, either to accompany you when you apply or be available when you have a home visit.

Best of luck.

, thanks for your anwser; I might do that then ๐Ÿ˜Ž still think it's a bit annoying that there will always be one month every year where we are not allowed to travel. Not a big deal right now under the pandemic, but usually, I travel almost every month of the year, so I need a bit of extra planning in the future ๐Ÿ˜Ž

in early 2020, when travel was easier, I flew to Australia while my extension of stay (Non O married to Thai) was under consideration. I had to go for just a few days. I got a re-entry permit and it all worked fine.

Now that travel is a bit more difficult and dates are less reliable, I'm not sure if I would try. But it did work then...

>1) Is it one month before I can apply for a new visa?

Depends on the immigration office. Some are 45 days, some are 30, and AS OF RIGHT NOW, Bangkok immigration is 3 days

>2) When I hand in the application to immigration, will immigration keep my passport under the consideration period?

No they will not

>3) is the consideration period one month?

Depends on the immigration office. But most are for one month.

>4) if immigration doesn't keep my passport, can I travel internationally while my application is under consideration as long as I am back on the appointment date?

I have never seen anyone getting a re-entry permit on an under consideration stamp. I recommend staying in Thailand during your under-consideration stamp. IF you have an urgent need to leave Thailand, talk to YOUR immigration office about your options.

>5) will immigration need to visit me at my house like they did the first time last year? If they do, then of cause I cannot travel?

They might. It depends on the immigration office.
