What type of visa should my friend apply for to stay in Thailand for 3 months before marrying a Thai national?

Writing a post for information for an older friend wanting to achieve a visa. He isn't computer savvy but has approached me asking about a Criminal Record Check for his visa application? (When I was on them in 2013-14 with the then Thai wife I didn't have to worry about any of it)

He wants to stay in Thailand for 3 months. He isn't married to a Thai national yet but does have his long term girlfriend who lives in Buriam. She has supplied him with a letter to confirm who she is and where he will be staying in Buriam. I have spoken to the girlfriend (she is a long term friend as I speak Thai) but she is as confused as I am. Because he wants to stay for 3 months and will marry his girlfriend during that time, he seems to think he needs a 90 day O Visa. Because he isn't married yet and is only wanting to stay in Thailand for 3 months, then my understanding is he can't apply for an O Visa based on marriage because when he applies for the O Visa here in Australia, he won't yet be married. I'm thinking he just gets a tourist visa and marries her during this time and on his next visit he can apply for a 90 day O Visa because he will already be married to a Thai national. So can someone please help?

1. Because they are not officially married yet or registered at an Amphor, should he be applying for a non-immigration O visa or a single entry 60 day tourist visa and then apply for a 30 day extension at immigration to achieve a total of 90 days?

2. If he is able to apply for a non-immigration O visa, is the Police Check Certificate to be submitted from the Australian Police, The Royal Thai Police or both?

TLDR : Answer Summary
A person wishing to stay in Thailand for 3 months to marry a Thai national should apply for a tourist visa instead of a Non-O Visa, as he is not yet married. He can then marry during his stay and subsequently apply for a Non-O Visa for married couples during his next visit. Additionally, if he decides to apply for the Non-O Visa, it is suggested that he inquire whether a police check certificate is needed from the Australian or Royal Thai Police, or both.

Keep it SIMPLE...

Just get the tourist visa..

Then when in Thailand get married...

Register the marriage..

Apply for non o married to Thai and one year extension of stay by meeting its requirements...

Including 400,000 Thai baht deposited in his name only in a Thai bank account.

No police record search required.

No special insurance other than that needed to enter Thailand with Thailand Pass.

he is returning to Australia as my post says so no need to convert to O visa with bank balances for a 12 month stay. I am trying to convince him that 60 day + 30 day extension is like you say the easiest but he's stuck on a visa that "includes marriage and 90 days" in wording. Doing my head in to be honest

exactly. Somehow he wants a visa based on a marriage that hasn't yet taken place.

impossible. And cannot do the typical Isaan Buddhist Temple marriage with big party...its not being legally married.

agree mate. When I married my wife we had the party but then registered the marriage at the Amphor. I was on a tourist visa at the time. I returned home and then applied for an O visa, sold up and moved to Thailand. His intention is to bring his wife back to Australia so the only time he should be applying for an O visa is if they want to return to Thailand on a 90 day or 12 month stay
