My friend has let his extension of stay due to marriage expire so is starting over. He’s from USA and currently on his first visa exempt with 10 days remaining before he extends it for another 30. He has 500k in a joint account with his Thai wife for a few years now. He would rather not leave country if possible to re-start the process for the NON-IMMO. What does he need to do further, even if leaving and returning country are his only option.

TLDR : Answer Summary
The user seeks advice for their friend, a US citizen in Thailand on a visa exempt status, whose marriage extension has expired. He possesses a joint account with 500,000 THB but seeks to avoid leaving the country to reinitiate the process for a NON-IMMO visa. A response indicates that to convert to a Non Immigrant O visa based on marriage, he must have 400,000 THB in a Thai bank account; he may need to transfer those funds or visit a Thai Embassy that has lower financial requirements.

To apply for conversion to a Non Immigrant O visa based on marriage and later for the Extension of Stay based on marriage the person needs 400.000 Thb on a Thai bank account. You mention he has only 250.000 Thb, which means not enough so he has to travel to a Thai Embassy who hass less financial requirements like the one in Savannakhet Laos.

OR

open a new bank account on his own name and transfer 400.000 Thb for conversion to the Non Immigrant O visa and later the 1 year Extension of Stay at a local Immigration Office.

thanks, So I guess the 400,000 baht needs to be seasoned in his name only to apply here in country, correct? Or he can leave country with money as is and return and apply for the non imm o. What are the date requirements to apply for the non imm o and then the extension of stay. I’ve read you need at least so many days left on visa exempt or something like that

Or your friend may be able to put the balance in the current joint account up to 800K

if he does put the whole 800k into the joint account can he apply for the non imm o here in country. He’ll have have 30 days left on his extension of his visa exempt. We will also confirm local requirements. Just trying to relay rough round the edges information for him

yes, but make sure with his local immigration office to make sure it would be accepted there (some IOs do not do it willingly). With a joint account, evenly divided amount is considered as his own balance. So if they have 800K in the bank, his balance is considered 400k.

The seasoning requirement is for the 1 year Extension of Stay, First he need to get the Non Immigrant O visa.

15 days remaining in Bangkok, 21 in Chang Mai, it depends on office, but ASK Immigration as when he goes to apply for the 30 day Extension of Stay based on tourism. AND ask the list with requirements.
