What should my friend do if he doesn't obtain a Non-O Marriage Visa in Vietnam and needs to return to Thailand?

Ark for friend.

He is American live in Thailand more than 3 years with Non Immigrant O-A Visa, his visa will expire on Feb. 8, 2020.

He have no money in Thai bank for deposit requirement.

And he has plans to apply for the visa at Ho Chi Min for Non-O Marriage on Jan.31, 2020 before returning to Thailand.

The question is if he does not get the marriage visa in Vietnam does he have to have a Thai reentry permit when he comes back to Thailand?

If he does not have a reentry permit, can he get the tourist visa instead?

In case of he somehow will not get new visa:

He needs re-entry permit before he leave to enter on current extension again

Or

He may be able to enter on visa exempt scheme for 30day which can be extended 30days as tourist or 60days visiting Thai family

If you are asking that if he can get tourist visa instead of Non-O when Non-O (based on being married to Thai national) application denied, he cannot. He needs to apply for Single entry tourist visa separately.

front&back of the original marriage certificate

front&back of your thai wife's i/d card

thai wife's house book listing

data page of your passport

lao visa and entry stamp

2 passport sized photos

a filled out application form

Show the original wedding certificate

you sign everything with your name on it, your wife signs everything with her name on it meaning you both sign the marriage certificate. 5.000 Thb and you get the 1 year Multiple Entry Non Immigrant O visa based on marriage

If the wife did a name change:

Tabien Baan name change edit on the back page from maiden to your surname OR

The certificate that shows an official family name change

For HCMC he also need a letter from the wife in which she ask the consul to issue him a visa to visit here.

yes, a visa run means he need to visit a Thai Consulate and apply for the visa.

If he has this 1 year Non Immigrant O visa in his passport he get on each entry 90 days of stay. If you like to stay longer he needs to make a border run, stamp out Thailand, stamp in/out neighbor country and back into Thailand for a new 90 day period.

Likely he has an extension based on the O-A...using US Embassy Affidavit of Income. Which is no longer available.

If he goes to either Savannakhet or Ho Chi Minh VCity... He could obtain a Non O visa based upon Married to Thai.

Just have the required documents with application.

If he has 400,000 Thai baht in a Thai bank he could obtain a one year visa married to Thai.

You have to check his passport first, you can not live 3 years inside Thailand using a Non Immigrant O-A visa.

Or he got another visa in the mean time, or he got an Extension of Stay from Immigratio.

He had received an extension every year by Thai immigration.

He use his income verification letters to prove his income instead of money in Thai bank account.

An OA visa is valid for only one year. Are you sure "your friend" is not on extension? And if so, are you sure your friend has no money in Thai bank? Final question. Are you telling us everything?
