What should my brother do about his TM-30 and 90-day reporting before he leaves Thailand?

Hello. My brother just received a new US Passport on Friday, and today he is getting the visa and stamps transferred, and a re-entry permit, before he flies out to the US this evening for a three month stay. As it turns out his 90 days check-in was due yesterday – so he is still with in the 7 day grace period – and his TM-30 was interupted after spending one night in a hotel several months ago. He had no idea that about the TM-30 until he received an email a few days ago. Will there be any problems if he waits until his return to Thailand in July to deal with the TM-30, using his new passport? I assume the 90 day check-in won't be an issue since he is leaving Thailand within the grace period.

Any thoughts or suggestions?

TLDR : Answer Summary
The user is asking for advice regarding their brother's immigration situation in Thailand, specifically concerning his 90-day reporting and TM-30 filing. His 90-day report was due while he is still in the 7-day grace period, but he plans to leave the country soon. Community responses emphasize that he must file the 90-day report in person before leaving. Additionally, he needs to address the TM-30 as it is integral to maintaining accurate immigration records, and failing to do so could result in fines upon his return.

Just so EVERYONE is clear about the 90 day reporting

This is how it works

IF you are INSIDE thailand on the date a 90 day report is due (as in you have NOT left the country during the previous 90 days) you REPORT, period, end of story

The window of opportunity to report IN PERSON is from 2 weeks before the due date to 1 week after the due date <- that does NOT mean if you are leaving thailand within the week after your report is due you don't need to report.

So, let me state it one more time so people catch on; IF you are in the country when a 90 day report is due, YOU REPORT...

Also though it should go with out saying I will say it, IF you exit the country on or before the 90 day due date when you come back in the 90 day count down clock starts over and your next 90 day report is due 89 days from the date you stamp in

@Tod ********
if my 90 day reports is due may 1st, I can not flight-out today and come back on may 7th?

@Wolfi ********
the real question is WHY would you fly out and back just to get out of a 90 day report?

@Tod ********
it's to avoid doing the 90 report and especially to enter just some days before my Non O-A Visa exempt (get another year with a new 1 year medical insurance certificate)

perfect answer (y) yep you do not need to file a 90 day report if you exit on or before the due date AND good luck with your trip out and back to get a new year entry stamp on your currently valid OA visa (y)

You sound like you have a workable plan and should have no issues

as long as you stamp OUT of thailand on or before your report is due the 90 day count down clock resets and starts over when you stamp back into the country, and your next 90 day report is due 89 days from the date you stamp in

thanks for your fast answer. So not necessary to do the 90 day reports 14 days before due when I leave Thailand before the due date πŸ‘Œ

and yes, when they come back they need to file a NEW TM30 because the online 90 day report system and the TM30 system are cross-linked so they check the address you use with the latest TM30 filed and if it's a different address (like you stayed in a hotel somewhere in the country then they will reject the 90 day report as the address doesn't match the TM30 on record)

He needs to do his 90 day report before he leaves Thailand. It was due yesterday as you stated.

IF he does not, then after he returns to Thailand, the next time he needs a service from Thai Immigration, he likely will be fined 2,000 Thai baht for not filing his 90 day report when IT WAS DUE.

GO get the stamps moved, get the re-entry permit, FILE a 90 day report in person and if needed file the TM30 (and take the 800baht fine for failure to file on time)

you are slightly confused

there is no "grace period" if you're leaving thailand πŸ˜• that 7 days after is IF you are filing in PERSON, not flying out within a week from the due date
