What should I do if my tourist visa extension is denied in Thailand?

I went to extend my visa. Hold a tourist visa. They said that I have been in Thailand for too long. It cannot be postponed again unless I buy a ticket to return home. Has anyone encountered this situation? I have extended it about 6 times. In Bangkok.

“I will definitely tell you how I was basically RIPPED OFF. Almost a year ago I went to a guy named PEE SOMJET his business is called PHUKET VISA LAW OFFICE Now “law” IS a stretch. HE IS LOCATED ACROSS FROM SOI TA-EID & DIRECTLY ACROSS THE STREET FROM KFC. IN THE BUSINESS AREA, BOTTOM FL. YOU CAN’T MISS IT OR MAYBE YOU SHOULD! THERE IS A LARGE YELLOW SIGN ON TOP!!

I have used him for 7 years & not had a problem but this time I did. He provides or says he provides visa services. Usually that is true. However, this time it was not. Be that as it may I brought my passport in and he said it will be ready in two weeks with my retirement visa. I paid33,800b & thanked him. Two weeks come and go, no visa OK no problem a month goes by OK still no problem. Since it’s Covid-19 I can’t travel because the airports are closed. But My 90 day check in was coming up so I want to make sure at least that was going to be done. He said to me “NO problem”. This is actually part of his services. This having no visa drags on and on and on and I give him the benefit of the doubt because I know it is difficult times with COVID-19. Plus I’ve known him for 7 years. He continually tells me that because of COVID-19 various immigration offices are closed which is true. So again no problem for me as long as my 90 day reporting is being done. (Which he says it is.)

Now I have learned that my mom is in the intensive care unit. Not knowing if she’s going to live or die I contact him on social media because he cannot be reached by telephone. He won’t pick up his phone. Anyway, He is made aware of the situation and shown pictures of her in the hospital attached to oxygen. This information is also sent and given to his secretary just to make sure he received it. Well wouldn’t you know I get no response at all - crickets, nothing, nada, no response whatsoever. (SO I SUMMISE HE DOESN’T GIVE A SHIT) Of course, at this point the visa is not important to me but my passport is. Again communications ensue, phone calls, line application, instant messaging, nothing! So at this point I can only hope for the best. I find out that without my visa I am still able to go to The airport. But I can’t even do that because he has my passport. I would have to pay a hefty fine but I cannot return for one year. Well after 20 years I I have established I self in Thailand so to leave and not come back would affect many people. Not to mention my family. Now I am F’N Pissed! There is literally nothing I can do without my passport or visa so more months go by. I finally get a hold of him and he says my passport and visa will be ready in a particular month and he doesn’t know what day specifically in the month. So the end of that month comes and I get on the bike - (His secretary called and said he’s in his office) so Breaking all the rules and go to the office and wait. So basically, I had to hunt him down. I surprise him @ his office and he says my passport and visa are not there. “What can I do“ at this point I was livid. You can only imagine what I feel like doing but I didn’t. In the background you can see his big screen TV with his commercials on it that say visa, overstay, etc. and how much and no problem. I saw this and was extremely extremely beside myself because after he said “what can I do” I said you are the lawyer what do you mean what can you do. Oh and by the way I find out he’s not a lawyer! He showed me pictures of his graduation which led me to believe he was a lawyer. Wrong wrong wrong! I told him I need to be back in the US and he said you don’t have your visa yet but you can take your passport to the immigration office in the airport and pay the 20,000 b fine and be blacklisted for one year. This is truly what he said to me. I could not believe it! I’ve been waiting almost 9 months for my visa and this is the answer I get. He said he can have my passport back here the following day, but without the visa. I was so incensed I couldn’t think of the words to respond. Of course it took approximately three days to get my passport back and of course no visa. (I thought here we go again)

The passport finally comes back without the visa, (Big surprise there) and even though he said he had been doing my 90 day Reporting he had not. So now I have almost a year overstay and no reporting (Great) I went to the Phuket volunteer immigration services. (Had I gone to a regular immigration officer I would’ve been put in jail and deported immediately.) The volunteer immigration individuals said I should get a ticket and leave that night. They were being a little over cautious but still the statement was not lost on me. I decided to stay a few more months, take my chances and hope I did not run into immigration and get my affairs in order, and retain an attorney as well. Then bought my tickets and left and hoped in the meantime immigration was not on my tail. I went to Phuket international immigration and paid a large fine (20,000b) and I Received my black list for a year and the litigation continues. But I thought I wanted to tell you so you know that a guy named Pee Somjet of PHUKET VISA “LAW” OFFICE- located directly across from KFC & SOI TAAIED IN CHALONG is very very questionable. To this day I have not received an apology or any thought of returning monies spent for his services to originally get my visa. Be aware please!Also I will be publishing this on all social media accounts and re-posting many times.”

you’re a lucky man , my friend from the US missed his visa extension due to being in hospital for 2 months (close to death at 1 point ) he ended up getting 6 months in the Bangkok Hilton before getting deported ! He’s black listed for 5 years (3

I sense some absurdity here. This is the government that tries to revitalize economy with STV long stay visa and promote tourism by just one day quarantine. Yet, they torture tourist visa holders and obstruct their wishes to stay longer. What an irony. Can't they just extend the TV if the holder has funds, vaccination etc.. So strange, backwards thinking

It used to be some people stayed 20 years doing border runs with visa exempt but about ten years ago they started getting stricter and only want people on tourist visas to stay no longer than 6 months for any 12 month period. If they want to stay longer they need to get an applicable visa.

I agree with what they try to do "in good times with strong economy and jobs". But as you know thailand is now risking covid19 fight by bringing people across the world to thailand just to boost their almost dead tourism and economy. So a resonable one would expect that they act smarter and keep those good tourists with money and vaccine inside thailand not send them out the country. Almost shooting themselves in the foot. No other explanation

Almost all Thai immigration transactions depends on the mood of the officer or their boss. I was given hard time at airports by female officers, now I know not to line up in front of them. In short I would switch to another immigration office if you can, most likely they will treat you differently.

James M Plower I have found the Female Officers to be the best for me. . A few years I was departing and had not been out in years and a Make Officer claimed I had Overstated even though I had continues Extensions of Stay based on Retirement. A Female Senior Officer sorted it out in short order

apologized and had me in my way.

Last Visa Extension I had a female officer and actually had fun joking around in my very poor Thai. All my paperwork was in order and I was in and out in less then a hour. She even did, without me asking, my 90day early ( I had no form prepared) which I had planed to do as normal at a local mall I shop in anyhow.

When renting the country always asked a Female Officer if I could go though the Thai line with my wife never refused so I'll stick to females.

I had great experience with female officers at the local immigration offices, they work nice. However, at the airport I heard many people were scolded by female officers. In my case my 60 page US passport had many thai immigration stamps and visas in the past 5 years. But only one land crossing and 1 tourist visa in that year. I came for visa exempt entry. She scolded me for too many thai visa on my passport and called a senior guy. He was kind and sorted out the issue and I entered.

The covid visa extensionwas always going to come to an end..really it just replaced the old 'visa run' but now that option not open. Going to be a few folks leaving Thailand soon with flights resuming.

not actually. I know TWO verifiable real cases of people who were at both Chaengwattana and MTT (they had visa exempt and a tourist visa) and they were both told, you've been here too long, you can't get a covid extension until you buy a ticket out and come back.

I know this because they got ahold of me. I told them to buy one of those 'throw away' tickets from an onward travel site. They did, got the confirmation printed and went back and successfully got their covid extensions inked in

So you don't actually have a visa, you have an "unable to travel due to covid" extension? So with air borders open, with multiple overseas airlines flying in and out, and just about every country around the world open, where exactly are you claiming you're unable to travel to? If you get a letter from your embassy saying your country is closed to incoming flights and present this to immigration, they may look at it with more empathy.

We are seeing more and more people; especially ones who've been here milking ways to stay here since before the country locked down back in March 2020, being questioned and sometimes denied when asking for covid extensions now.

So if the immigration office told you in order to get another covid extension you need to show you're leaving I'd GO buy a ticket back to where ever you come from that shows you fly out in about 2 months and then go back and then apply for another covid extension.

And just so you're clear you couldn't have gotten 6 covid extensions because you've only be able to get those since Nov 1st 2020 and this last 60 day covid program that expires on Nov 26th was the 5th one. 😛 So it would appear you've been here quite some time

he had to take the amnesty or the embassy letter, NO ONE has SIX covid extensions. One last time they only started issuing them in Nov 2020, and this current covid program is the FIFTH one, before that it was amnesty or embassy letter

nope they don't give only 30 days, you need to know your ass from your elbow about how the covid extensions work. SOME offices give you an under consideration stamp and then you go back to get the covid extension inked in. It's NOT that you're getting two 30 day covid extensions, ALL covid extensions are for 60 days, it's that you have an under consideration stamp on your application BEFORE you get the covid extension and the total is 60 days

Think about someone who came say nov last year isn’t not rocket silence mate it’s logical the came visa except been here a years that 6 Covid extensions plus the origanal 30 they had to do . You have an extension of stay due to unable to travel or a 60 day covid extension. The last day for getting a covid extension is November 26th but it seems that some immigration offices are now demanding proof that you are actually going to leave Thailand. Suggest you buy a ticket out and apply for covid extension again. Note it’s at the discretion of the immigration officer whether he grants you an extension or not.

This is normal. You are not supposed to stay in Thailand long term on a tourist visa. You have only been able to stay this long because of the Covid extensions. Time to return home and sort out a proper visa for long term stay.
