What should I do if my education visa is about to expire and I need to marry a Thai national but can't get the required documents from the US embassy?

Need advice, I thought I had this all figured out until the US embassy cancelled my appointment for next week. My 1 year education visa expires Jan 15. I planned on returning to US yesterday but due to covid epicenter issues there. I moved up my marriage, we planned it after I returned summertime. So now that the embassy isn’t available for the affidavit it puts the Amphoe visit on hold. What do I do ? My options to fall in to amnesty ? Or can I file the TM7 with the pending marriage to follow ? Thank you.

it is highly unlikely that you're gonna be able to pull off getting the affidavit of freedom to marry, getting it translated, getting it certified by the MFA and then getting an amphur to register the marriage so can get to the immigration office and apply for a marriage extension before your ED visa extension runs out. :/

Even if the embassy accepted your emergency request (I'm not even gonna ponder how getting an affidavit to marry qualifies as an emergency :O) I don't think you can pull it off in the short time you have.

That's why I suggested a way to "buy you time" by getting documentation from your school stating you stop studying on the 15th of Jan, go to the immigration office the week before that, cancel the ED extension, (they will give you a new stamp saying you can stay until the 15th) and then immediately apply for a 60 day unable to travel due to covid extension.

That buys you two months more time from the 15th of Jan.

Then you don't have a gun to your head time wise and can take the time to get everything done step by step and after that go back to immigrations and apply for the yearly extension based on marriage to a thai once you have all the stuff you need.

Yes he is Thai. Embassy just accepted my emergency request so I might be back on track and thanks for the details. I haven’t been following amnesty since I was covered but plans change. :)

Anyone reading this who is still not aware, you CANNOT "fall into amnesty". Amnesty finished on October 31st. If you do not have a valid visa or extension stamp in your passport, you are accumulating overstay fines at the rate of 500 baht per day. Amnesty is finished - go get a stamp!

You got no choice to file a "pending marriage" extension,.

Get paperwork from your school saying you stop studying on Jan 15. GO to the immigration office a week or so before that date, cancel your ED extension, then immediately apply for a 60 day unable to travel due to covid extension. You'll get a 14 day under consideration stamp, then go back on that date and get the 60 day extension.

That will buy you the time you need to get your shit together to get the affidavit of freedom to marry notary, get it translated, get it certified, get your marriage registered and then hopefully apply for a 90 day Non-O visa based on marriage

Just so you're totally clear, there is NO amnesty. That ended on Oct 31st ;)

Let's see if I can't untangle this post. Here's my understanding of what you have:

1. You're an unmarried American, on an ED visa.

2. Your ED visa is expiring in January 15

3. You need the paperwork from the US government to give to the Thai government showing that you're unmarried and legally able to be married.

4. You want to stay in Thailand past January 15.

Is this correct?
