What options are available for an expat husband whose B visa is expiring due to allocation limits?

Hello folks, I hope you don’t mind my posting here (was declined in the other group) but I need your help in finding options for my husband (I am on a work permit, married LGBT couple). We used TVC to get him a B visa (expiring in Jan), and now we were told that they ran out of business visa allocations (and will be available again end Jan of 2024. They said they cannot help with short term or long term extensions for now. Given this situation can anyone recommend what my husband can do?

It is a visa run I am afraid. But do check as I believe it's January 1 that they bring in same sex marriage laws. It's been approved by new government....check it up, Bangkok post usually. I will have a look for you. But I know it's very soon. This year they allowed us on valentine's day. It was a special but now it's going to be law that same sex can marry in Thailand and will be recognized as such.

depends on the passport country. Looking at around ฿40-55k for the first year.

You can always reach out to them; they are quite friendly.

thanks, my husband’s one year non immi B is actually issued through Thai Visa Centre. I abbreviated their name (TVC) in my original post. They have been awesome and supportive this past year, but no visa allocations available until potentially end Jan they said.

yes, thanks for your insight. I also mentioned in my original post that I used TVC, and in another post I mentioned was hoping to see if there are other alternative agents or options we can take. I am posting here as a last resort. 😊

try a recruitment company that offers “Employer of Record” completely legal and available as they are BOI registered so no limit.. expensive but workable.. try someone like ADI in Silom

Ran out of business visa allocations?

There is no such thing as running out if its all being done properly and you meet all the requirements .

By saying ran out it suggests it was going to be incorrectly “obtained” for you any way.

it is not so much a quota as it is meeting the financial requirement, being bt2million in registered capital for each visa/work permit. When the corporation they are using reach their financial limit then unless they put another bt2million into registered capital they can't sponsor anymore workers. Some refer to this as a quota.

ahhh...that's what it is. TVC wouldn't help me with opening a bank account then also wouldn't help me with a retirement visa due to a similar issue of having reached their "quota". I was not actually trying to skirt the system in any way. I only needed help. I was happy to put in the proper deposits. Now, I understand what they meant by the quota. Thank you.

Take a 6 weeks vacation somewhere, at which time it will be late January and you can put in the new visa application.

Or just take a Christmas holiday trip for a week or so to Singapore which is fun over the holidays and then re enter and depending on what country on an exempt for 30 days renewable.

the OP is using an agency that is supposedly hiring people, to qualify them for non B visas, so the agency is limited in how many they can do under whatever sham structures they've created to get around the law.

there isn't a quota if they go through immigration and meet their criteria. If they can't meet their criteria people resort to using agents who use "unofficial" methods to obtain visas for their customers. Some are better than other, just depends the length they go to

yeah I was actually surprised to find out about this too. I have been seeing announcements from TVC on LINE about visa allocations running out periodically over the past 10 months, but because it wasn’t previously relevant to my husband’s situation it wasn’t that much of an issue. Obviously now it is!

it can be for agencies who don't follow the rules but it can also make life difficult. Immigration doesn't have an allocation of visas, you either meet their requirements or you don't

If TVC as already advised you, then i think you already have the best info. Have your partner do some traveling to use up the 2-3 months. Or get a tourist visa at the appropriate consulate, which will give you 60-90 days, then switch to the Non-B 1 year extension or whatever TVC offers.

actually, even Thai Embassies and consulates have quotas... But they rarely hit those now.

The local Thai immigrations offices in Chiang Mai and others used to have daily queues to apply for extensions. Perhaps that has changed now 🤷🏾‍♂️

If from visa exempt country, then do a border run to get 30 days, can extend for another 30 at immigration. Hopefully that will allow you time to get a long term visa sorted

yeah thanks for your advice. This is what TVC also advised to be the only option available. I was actually hoping he didn’t have to do this and that there are other agencies that maybe folks here can recommend 😊

it's a bit of a pain, but pretty cheap. Think it's about 2500B with a border run company from Bangkok to Cambodia for Philippines passport holders. About 10hrs all up.

Maybe try searching the group for "agents" as there's a few posts with recommendations. Mostly in Pattaya, but a few in other locations too.

I think talking to a Pattaya agent is best if you two can make the trip when necessary. They seem to have the most flexibility there.

Instead of criticising othes for mentioning their sexuality when it becomes an actual impediment to their life, maybe be thankful that you don't need to worry about being in this position.

As in, if you came here with your wife, you would not have this problem. Your marriage would be recognised here, and she'd just be able to get a dependent visa.

Instead of complaining about people raising the issue of discrimination for being LGBT, maybe be thankful that you don't need to worry about being discriminated against for being straight.

the parameters for ‘married’ and dependent status are quite rigid for Thailand. Same for many nations globally. Includes non recognition of any form of civil union, common law etc. Not sure those would be perceived as discriminatory, but it is what it is. Half the world moving forward in one direction, and half the world in another direction. Interesting times

, I pointed out our sexuality because normally the spouse can apply for dependent visa, but in our case he can’t as our marriage is not recognized in Thailand. Thanks to the others for picking up on that point 😊
