What is the process for hiring foreign employees in a BOI company in Thailand, and what paperwork is needed?

Hello! Is there anyone here who owns a BOI (Board of Investment) company? We have an approved company, and now are adding 2 foreign employees. They just successfully got their visa stamp in Malaysia!

Now I know we have 3 months to get this completely finished with immigration as well as the labor department. Has anyone been through this process? What paperwork is required from immigration and labor department? Which do we have to go to first?

BOI companies are SO different from standard Thai companies, there is not much info out there.

Any input would be appreciated!

To my knowledge it is only for expert jobs entering thailand, so i assume that for the normal WP you still need the 4 thai per foreigner. Think better to ask a good lawyer knowing about this

Yes. For experts, but Not the same work permit. BOI offers unlimited foreigners with no Thai requirement for the first 4 years. It can also be 100% foreign owned.

So, t's not a standard work permit. It will be the digital variety from what I understand.

Yes when the foreigner has a special expertise difficult to find in thailand, but not sure on normal work, so you better ask a specialist i think

The work is highly technical. Employees are already approved by BOI and embassy. Just have to hurdle the labor dept and immigration now.

Just make a visit to the BOI office on the 18th floor at Chom Chiri Square, directly across from the immigration office you use being a BOI company. They are very helpful, and will get you on the right track.

Thanks! I have been in touch with them a LOT, but these are the questions that they aren't super specific about.

BOI is super hard to set up. I'm sure they're tired of me. LOL

just like any business, even a BOI business setup, you must have bt2million in registered capital for each work permit. As a BOI company you do not have to have the 4 Thai employees for each work permit.

Setting up as a new corporation is intensive, much more so than setting up a branch office of your foreign company, which most do.
