Hi everyone, I’m left a little confused as to how I should go about getting a WP3 for myself, as the managing director of a private limited company. I am currently getting a lawyer to set this up for me and understand how to overcome the 2 million capitol issue but it seems I’m unable to get the Business Visa without a WP3 and unable to get the WP3, without showing the social security payments for 4 Thai employees. Also having the provincial Labour department coming to check on the Thais, employed by my business. I’m hoping someone can offer some advise as I’m a bit unsure if this being the case why would anyone be traveling outside Thailand to get a business Visa and so avoiding the 4 Thai employees requirement. I could just get a year Visa in the immigration office as extension of stay, if you need to show this to get a work permit. My business is a small start up and currently can’t employ 4 Thais full time. As the managing director, am I unable to get a work permit unless I meet the requirement of 4 Thais employed if I wish to travel outside to Malaysia Penang to get my Visa. How can I get the WP3 in this situation?

TLDR : Answer Summary
A user is seeking guidance on obtaining a WP3 work permit as the managing director of a small startup in Thailand. They are confused about the requirement to employ four Thai nationals and pay social security contributions to validly apply for the WP3 and subsequently the Business Visa. They are exploring options for traveling to Malaysia for the visa process while unsure about meeting the employee requirements.

Well follow the law like in your home country .

Yes your lawyer or accountant can handle this yes u need a 2 million company and yes for each foreigner you need 4 Thais employed ....to get the WP3 letter you need to pay the social security and yes for your Visa B on WP 3 at the moment your lawyer ask for you have to be outside of thailand ( only at this day ) ...Getting it is very easy in Penang

If the law says you have to show the social security payments of 4 Thai employees before you can get a work permit, then you'll have to show the social security payments of four Thai employees.

I think one way around this requirement is to open a Treaty of Amenity business (if you're an American); talk to the US State Department for more information. If you aren't an American, then that's not an option for you of course.
