My partner and I have just been confirmed for BOI approval. Is there anyone here that has done this process before that could lend an ear and some answers? Here are the details and question.

- My current work permit has expired.

- I’m on a Non B 1 year obtained at Penang with another company than what we will be transferring the BOI certificate to.

- My current non b expires March 17.

- My business partner is the MD of the company we will be transferring the BOI certificate too.

- My Business partner has a 1 year extension of stay and work permit with another company Han what the BOI very is being transferred to.

- I am not currently a shareholder at the new company yet, we have avoided redistributing these until after we transfer the certificate.

- My partner is a shareholder of the company we will transfer the BOI certificate to.

My business partner and I both would like to obtain both visas and work permits to our BOI company ASAP. The BOI Office has said it will take around a month to transfer the certificate.

My question is, can/should I just stay in country for the next 90 days(I came back into Thailand last week) in hopes of everything being ready with a month or 2 for being setup with our BOI company?

Or will I need to leave and get a non b anyways to convert to the Boi visa?

It seems that the one stop shop will have answers for us come Monday, just wondering if someone else can confirm what they tell us.

Thanks for all your help as usual!

TLDR : Answer Summary
The user and their partner have received BOI approval but face questions regarding their visas and work permits amid the transfer process. Specifically, they are unsure if they can remain in Thailand for 90 days while waiting for the BOI certificate transfer and if it's necessary to leave the country to acquire a Non-B visa. Community feedback suggests it may be possible to manage the visa transfer domestically, but some recommend getting a temporary Non-B visa if timelines are tight. They plan to seek further guidance from the BOI's one-stop service.

You must be a share holder and Managing Director to get a one year Multi-Entry B Visa in Penang and the same title must be typed in your Work Petmit. In Kota Bharu Director will do. Normally you Apply for your Work Petmit Before you go apply for your B Visa. If you are getting 90 single entry B visas - a bit easier

Just ask BOI.

noted and thanks. I also have possible work outside of Thailand after the 17th, should I fly back out and come back in on a tourist stamp, would BOI require me to obtain a non b again anyways? Or can I get it inside thailand with a tourist stamp?

@Joshua ******
Your visa expires on 17 March, but that does not matter, you have an Admitted to Stay period stamped in your passport and that stays valid until the last day. BOI will advice and sort this out for you.

I’m getting a 2-3 visa with my BOI company, not a 1 year multi from outside of Thailand. My question was do I need to fly out and obtain another non b since my current non b will expire before the BOI certificate transfer is ready.

Then there are no rules for BOI

No magic tricks needed, BOI companies follow the rules.

You can do domestic visa transfer without flying out. You have to discuss with HR or whoever work on visa whether there is position to be ready to register your profile with BOI system. If not I'm afraid the time is quite tough to do profile registration. So what I advise is to get the void stamp before visa expiry date. Flying out to apply temporary non-B visa from Thai consulate located overseas. Finally do profile register in order to obtain

or 4 years visa (depending on type of business and agreement with BOI)

I give up. The visa is inside his passport and is used to give him an Admitted to Stay inside Thailand. But if you like, transfer the visa to I do not know where. But believe me nobody will ever rip it out of his passport.

Look... He mentioned he currently holds non-b visa which can be transferred without flying out following BOI benefits. I've done the case before last month and it was successful. But his expiry date is 17 March so l just offered him another option.

I guess you mix up a lot of terminology. domestic transfers of what? a Visa gives you an Admitted to Stay inside of Thailand and does not have to be transferred. Apply yearly visa, I guess you mean apply at the BOI office for the 1 year Extension of Stay. Next to this it is even possible to convert from a Visa Exempt Entry or a Tourist Visa into a Non Immigrant B visa at local Immigration Office, if you meet the requirements and guessing that if BOI gives you the certificates you can meet those requirements.

In order to submit non-b visa. All employees need to have this kind of visa (if they cannot do domestic transfer) to be origin to apply yearly visa. That's from my experience from dealing with BOI and Chaeng Watthana 6 years.

@Modern ************
That is the normal Single Entry Non Immigrant B visa, you talk about some temporary visa? I like to know what you mean with that.

Here's an example.
