I’m from USA, first I know the Royal Embassy and Immigration are two different entities. My question is based on Embassy information, but got different info from immigration today. I have time to figure this out, my Visa expires 17 July 2022. The Embassy told me I can get an extension based on Marriage based on my Non- O/A Visa, today I did my 90 day report at Immigration and we talked about extensions, they said I can only do a retirement extension based on my Non O/A, please which is correct. I was at the Ubon Ratchanthani Office. They do income based extensions and that is not an issue. Just need to be sure to apply for correct extension. This would be the first extension.

TLDR : Answer Summary
The question revolves around whether an individual on a Non-O/A visa can extend their visa based on marriage or if they are limited to a retirement extension. The embassy stated that an extension based on marriage is possible, while immigration officials indicated the only option is the retirement extension, as the initial visa type dictates the first extension reason. Participants clarified that for the first extension, it must match the visa's purpose—retirement in this case—but subsequent extensions can change based on marriage. Further discussions included the requirements for financial proof related to extensions.

now as the people at the immigration office AND other posters in this thread correctly pointed out IF you enter the country on an OA visa entry and go to get an extension of stay at the immigration office you MUST get the first yearly extension for the reason the visa was issued (and OA's are issued for being over 50/retirement)

Once you do ONE yearly extension based on retirement when you go to do the next one you can change the reason for the exetnsion and do it based on marriage to a thai if you wanted.

got it thanks

You need to apply for the first extension from entry stamp for the same reason with your entry stamp. So If you enter on Non-OA, you NEED to apply for a 1-year extension for retirement reason. But you can change the reason for your next extension to marriage.

Yes understand all demands of money and insurance just a little confusion on what year long extension to apply for, my current stay is stamped till July 17 2022

I think if you want to retain that Visa you have to leave and return before the Expiry Date on the Visa which is June 10/ 22. Once you go past that date the O/A Visa is void .

correct😊

Once OA then always OA. Meaning your extension has certain demands which are different from a similar Non O (retirement). With a OA you always have to proof your in and outpatient health insurance.

What is your current permission to stay date stamped in your passport?

If the OA visa can be broken...by leaving Thailand...

And you reenter on a tourist visa or visa exempt entry...

Do you have the 400,000 Thai baht required to get the one year extension of stay based on marriage to a Thai ?

You have an OA visa with expiration date of June 10, 2022. As such, if you bounce out and reenter Thailand before June 10th and you will be stamped in for one added year. You will need to show proof of the OA insurance for that one year period to get the full year stamp. No funds need to be deposited into a Thai bank.

@Tod ********
sorry but this has always confused me. So the 400k requirement kicks in only once I move to an extension of stay, not on this initial (visa) period.
Philip *********
Thanks for the clarification - most appreciated.

@Philip ********
correct, it is a seasoning requirement once you GET an extension going forward, it is not required when you apply for the first one

For the first yearly extension it's just show the 800K baht has been in a thai bank account in your name only for 2 months before you apply for the extension 🙂

@Tod ********
so to clarify, I would do the extension of stay before the expiration of the latest stamp (e.g. after my “second year”), at which point, I must have the usual 800k. So is that also saying the 400k minimum actually does not apply to OA?
Tod *********
@Philip ********
what I am saying IS when you go to apply for an extension of stay at the immigration office you meet the seasoning requirements. Seeing as you'd be applying for the FIRST yearly extension of stay at the immigration office the 400K minimum wouldn't have come into play at all

You would need 800K baht in a thai bank account for 2 months before you applied for the extension, you'd need to keep it in the account for 3 months after the extension was granted and then the balance couldn't fall below 400K for the rest of the year.

In this case you need a re-entry permit ?

@Christoph ****************
In the case of the O/P they hold a year long, multi-entry Non-OA visa that expires on June 10th 2022. <- IF they were to exit and re-enter the country on or before that date they would get stamped in for a whole new year (providing they had the mandatory health insurance coverage for the year)

So in theory if he exited and re-entered on June 10 2022, he could get stamped in until June 9 2023 😮 in essence getting two years of stay out of a visa valid for one year

Once the visa sticker expires if they wanted to exit/re-enter THEN they would need a re-entry permit to keep the previous entry stamp 'alive' so when they came back in they'd get stamped in for that amount of time.

@James *******
I also have an OA (from Australia), and full Health insurance. I see that the option to have one added year still applies (I did it some years ago), and note that I must add new health insurance for the new "one year", if I do a bounce in/bounce out.

Your last comment - no funds required. Are you saying that the 800,000 does not apply any more on an OA exit/re-entry? So this is different to the O requirement (800k then 400k minimum at all times)?
Tod *********
@Philip ********
you are using ENTRIES on the O-A visa to get that 'extra year' there is no proof of funds when doing that. You show that you're insured for another year when you stamp in and they stamp you for up to a year (or as long as your insurance is good for)

when you go to get an "extension of stay' at the immigration office is when you need to follow the seasoning protocol for the 800K baht banked money

@James *******
, correct, except that the visa expires June 10.

@Alf **********
thanks...noted.

You have the Non Immigrant O-A (Long Stay) visa, if you apply for an Extension of Stay you do this with the same reason, being over 50 years of age and willing to sit out the rest of your life in Thailand (also known as retirement).

@Robert ******
so immigration was correct and Embassy does not know what talking about, thanks

@Paul ***********
they're both kind of correct. As this will be your first extension it must be for the purpose the visa was issued, in your case retirement. Subsequent extensions can be for another reason such as marriage.
