What Happens to the Dependent DTV Visa After Divorce?

Does anyone know what happens to a Dependent DTV visa after divorce? I've emailed the issuing Embassy and haven't gotten a response. I'm just wondering if anyone has had any experience with this. I would think the visa would no longer be valid, considering the person is no longer a dependent of the main applicant, but I can't seem to find an answer.
Answer summary
The general consensus is that once a dependent DTV visa holder gets divorced, the visa technically remains valid until its specified expiration date. However, since the holder no longer meets the conditions of being a 'dependent', there may be legal or practical risks involved in using the visa. Most experts agree that unless the issuing embassy is notified of the divorce, the visa will not be automatically revoked. Yet, there are varying opinions on the matter, as some believe it's best to inform the embassy to avoid potential overstays or complications in the future.

Nothing will happen unless you send an email to the embassy or consulate where you applied for your spouse’s visa, informing them that you are now divorced and would like to cancel the visa and no longer sponsor the applicant. They will usually void the visa and send you a PDF copy of the original e-visa with “VOIDED” written across the page in red. Depending on the embassy or consulate, you may also need to attach proof of the divorce.

Anonymous participant 358 Highly likely you wouldn't get a response from that email. They'd see doing that as a waste of time. IMO

The embassy will not know. But it seems like you want it to be an issue

The dependant is no longer a dependant and the visa becomes invalid as the conditions have ended.

You are correct after you divorce then the dependant DTV becomes invalid as the conditions for having it are no longer met. That is straight from a Thai lawyer dealing in such things

You need a new lawyer. The conditions for issuing the visa were met.

If they had an extension of stay stamp then yes it would become invalid when the reason for the stamp finished.

I am fully aware DTV is a tourist visa and if you are no longer a dependant of the original applicant you no longer qualify to hold a DTv based based on dependancy.

Sounds like you're getting confused with Non Immigrant visas and aren't aware the DTV is a tourist visa.

When issued you have your “own” DTV. Regardless of the reason you got it - it’s yours. It’s a 5 year visa.

So wrong when you no longer satisfy the reasons for having a dependant DTV then it becomes invalid. you can stay until your 180 days are up then you must apply for your own DTV

Why would you ask? A valid visa (unlike an extension of stay) is valid until the end date printed on it. Enjoy you 5 year DTV - no matter if you are still married or not.

A dependent visa is fully independent after it's issued. I saw a case where main applicant was stopped by IO for questioning while dependent went without issues. 😆 There's a simple rule about Thailand: Ask less, invite less trouble.

Hypothetically the visa is invalid and continuing to use it risks putting the person into overstay.

That being said, it would likely require the issuing consular authority to cancel the visa because the conditions are no longer met.

UnforgettableRambutan8343 The first part of your statement is not true. For a visa, the requirements were met at the time of issuance. Thus, the visa itself is valid until the time it end date is reached. As it is a 5 year visa with multiple entry, enjoy it while you can. A visa is not an entry stampt or an extension of stay.

The DTV isn’t special. People on ED visas have been charged with overstaying when their course concluded but they remained in the country despite still having time left on their stamp.

Your visa is conditional whether or not you choose to believe so. If someone chooses to believe that the DTV grants them 5 years unconditional lawful residence in Thailand then that’s their own risk to bear.

While I respect the attempt, you are still conflating visa validity and validity and permission of stay. I could have a Non-Immigrant B visa which is valid for 90 days but I enter on day 89. I will (generally) still get stamped in for 90 days but that is my permission to stay. Immigration can still treat that in the same way as they would an extension and they can verify my employment and that my documents are in order. To assume that the DTV is different is absurd. Having a valid DTV doesn’t guarantee entry or guarantee that you’ll be stamped in under it. Immigration could decide to stamp you in under the visa exemption scheme if they so choose.

You seem to be projecting a bit as anyone who has been in Thailand a while will know that Thai visa policy is quite fickle and crackdowns happen periodically.

UnforgettableRambutan8343 You are confusing different things. Yes, a stamp (yearly ED stamp, extension of stay based on ED visa) can be invalidated when the underlying reason for the extension does not exist anymore. But in that case, the original ED visa would not be invalidated. It would not have to, as it would only be a 90 day single entry visa. You need to carefully distiguish between visa on the one hand and stamp / extension (of stay) stamp on the other hand. A DTV MULTIPE ENTRY visa will remain valid for its 5 years, even if after issuance the original conditions of its issuance are not met anymore. Otherwise, many people would be denied entry, either because their soft poer course had run out, or they spent part of their initial 500k THB requirement.

Nothing it's valid for 5 years.

Unless you specially ask the issuing embassy to cancel the dependent visa, visa would be valid as they won’t know about the divorce.

And even if they would, a valid visa is a valid visa, and unlile an etry stamp or an extension of stay based off of marriage or what not will not easily be cancelled.
