If I am on a non O visa based on marriage but it has been extended by my place of work, does my visa automatically get canceled if I get divorced? Do I need to change to a non B visa or is there other alternatives? Thanks

TLDR : Answer Summary
If you are on a Non-O visa based on marriage and your extension of stay is related to your marriage, getting divorced will require you to cancel this extension immediately after registering your divorce. You would then need to apply for a new extension based on employment, as your current visa would no longer be valid. It's important to check the details on your extension stamp and seek advice from your immigration office or employer for the necessary documentation to transition to a Non-B visa.

How about you actually LOOK at the current yearly extension stamp you have in your passport now and see what the "REASON" is written on it as far as why you have it?

You say you have a Non-O based on marriage but then you say it was extended based on employment.

Post an image of your current extension of stay stamp (the stamp you got from the immigration office that has the words "extension of stay permitted until"

ok, you DO NOT have an extension based on employment :O

you have an extension based on being married to a thai (hence the thai wife stamp on it ;) :P )

So now we know that IF you get divorced your current extension would need to be cancelled on the same day you sign the papers at the Amphur and "register your divorce", THEN as soon as you cancel that extension you'd apply for a new one based on employment here by turning in the correct documents from your employer.

All you would be doing is "changing the reason" for your extension from one based on marriage to one based on employment :)

I would go to your immigration office and get the hand out (or talk to your employer) so that you know what the requirements are to get a year extension based on employment

If your extention of stay is based on work then getting divorced wont affect that. Your Non Imm O visa based on marriage has already expired.

Are you on an extension of stay based on marriage or based on employment? I suspect you’re getting confused between your visa/extension and your work permit end dates.

no if you have an extension of stay based on being married that finishes the day you get divorced. You would then need to apply to stay in Thailand for another reason. Regardless of when your work permit says you can work until it’s the extension of stay that allows you to be in Thailand. You’d have to liaise with your employer and see if they can switch you over to a non B visa in country. That does require a serious amount of paperwork but can technically be done.

I believe you might be right, if this is the case does that mean I can change the visa status and get divorced without canceling the visa? Thanks for your help!
