What happens to my Non-O marriage visa in Thailand if my spouse passes away?

If divorced you will need 800,000b in a bank and reapply for a single person Non O or OA

When you are 50 or older, you can base your yearly extension on retirement. The financial requirements are higher though, 800.000 baht instead of 400.000 baht.

Well the marriage visa renewal requires proof that the relationship or marriage still exists. Death legally ends the marriage

If your visa is based on a marriage, and your spouse dies, you can remain in Thailand until the end of your extension. After that you either need to apply for an extension based on a new reason, or leave Thailand.

and if the spouse wants and gets a divorce then we have a short number of days to leave - think it is 7 - maybe less.

there is no number of days to leave. The moment the divorce is final, the extension is invalid. Most people will know ahead of time and plan accordingly.

not a question for you, but at least 2 people reacted with 'wow' and I was surprised. I was wondering what those who react that way would expect to happen or think should happen.

If you have a visa or extension based on marriage can you convert to a permanent resident easily to remove the death or divorce triggering the inability to get an extension based on marriage?

Ya as Lord Thurkettle mentioned. Permanent residency is not easy, like at all. And just because your spouse passes away does not get you some sort of brownie points towards it.

There's no "easy" path to permanent resident. But out of everyone, it's foreign women married to Thai men that will meet the least resistance. But that takes years, and it would have to be completed before the spouse dies or else their application would be cancelled.

curious, have you seen anything around least/more resistance when it is a foreign woman married to a Thai woman or a foreign man married to a Thai man? Just curious, if a foreign woman regardless to who she is married to would have easier go at it.

The owner of the group got notice from immigration that for extension purposes, foreign women married to Thai man will remain the only ones who do not have to show financial proof. All other marriages will require proof of funds. Thai male foreign male, thai female foreign female, Thai female foreign male.

I've yet to hear of anyone getting a visa or extension within Thailand based on same sex marriage, but based on the immigration policy, I would not expect there to be any preference to any other marriage type except Thai man with foreign woman

yes extensions are being granted for same sex couples. However I have not personally seen any female couples yet.

Is same sex marriage recognised by Immigration now? I thought it was only some Embassies and Brandon was referring to foreign wife/Thai husband marriages.

Not really sure what you’re asking here. If you have an extension of stay based on a particular reason and that reason finishes then the extension of stay finishes that day. Marriage, Work, etc.

The only difference is that if it’s based on marriage and the spouse dies then you can stay until your extension finishes. You’d then either need to leave or switch to another reason for an extension.
