Hi guys. So I have a situation that I have researched, found the answers, but am still really nervous about. Long story short my Wife's last school dropped the ball on some paper work. I have a 5 year old child who is on an overstay of about a year now. Was assured its not a problem, no fine, no blacklist, etc, but it still freaks me out. The new school has now said get him on an education visa, easy peasy. So the plan is to shoot up from Chiang Mai, do a quick border hop to Myanmar and get him an exempt. The current schools HR person is pretty on the ball and says no problem. Any advice? Better to go with an agency? Better to fly? Any paperwork I should take? I know technically the law means we won't get fined but TIT right. Basically just hoping someone who has been in a similar situation can tell me it will be okay:) Thank you

TLDR : Answer Summary
A parent is seeking advice regarding their child's overstay situation and the process of obtaining an education visa after a school mishap. Comments suggest there are no fines for the child, advise against using an agency for visa processing, and encourage listening to the school for necessary paperwork for the visa application.

Here's my opinion:

1. Your child is on overstay, but there is no fine or other punishments that will occur until your child is much older.

2. Do NOT use an agency to get the visa, there's absolutely no need.

3. Using the Myanmar, or other borders, what is your nationality? Not all nationalities can use all borders.

4. It should make no differences if you fly out or do a border bounce. You, or your child, *will not* get deported.

5. For the paperwork. listen to the school, and submit whatever paperwork they want you to submit to get the ED visa.

Our easiest bounce is Mae Sot. New to Chiang mai and this is what I have been told at any rate. The HR lady syas she can convert an exempt into an ed Visa easily as we have our own Visas and dont need to piggy back him. Was just going to drive up, cross and return unless anybody advised otherwise.

Your child wont get fined, they dont punish kids for having irresponsible parents, but will get an overstay stamp in the passport
