TLDR : Answer Summary
A spousal visa is not applicable here as one spouse is not Thai. However, the Filipina can apply for a NON-O dependent visa if her husband has a work permit, requiring an attested marriage certificate. Consulting with a Thai immigration lawyer or the local embassy is recommended for personalized advice. Others share experiences of securing visas, such as retirement or student visas, that allowed their spouses to stay in Thailand.

You guys can get married in the Philippines; good luck it takes months to process all the dang paperwork and the fees never end. Recently got our marriage license after insane amounts of effort

I think she offered you a clue when she said ‘my husband is American’. That should help you

My wife and I moved to Thailand in 2019, I was 53 years old and she was 48 years old, I got a retirement visa, and my wife on a dependent visa, what immigration requires is an original marriage certificate and a translation from our embassy in Bangkok. We are from Denmark👍

Spousal visa require one person to be Thai

My Wife is a Filipina too and I am British, the way we did it was for me to get my retirement visa and my wife had a student visa to learn Thai, once she finished her visa which was 6 months she was allowed to 'follow' me on my retirement visa, best thing to do is speak to these people here, they was very helpful.

@Tom *******
You are correct, that is how we did it too.

@Tom *******
we were told that if we applied for the retirement visa together with my husband as main applicant he only needs to have the 800k and not for me since I'm just a dependent. But since we applied inside Thailand they asked us to have both 800k..

@Alma **************
because you cannot get a dependent visa from inside Thailand using a Non-O retirement visa. It is normally only issued if the retirement visa is a Non-OA which can only be purchased in your country of residence.

@Alma **************
Obviously different if the 'spouse' does the ED visa

@Tom *******
why does she need a student visa when you have a retirement visa..it's perhaps the financial requirement ? We did a retirement visa in the beginning and we needed to have the 800k baht each ..now my husband's on a dtv and me as dependent only requiring 500k baht each
Tom ********
@Alma **************
As above and we only needed 800K for myself because my Wife is the dependant.

@Alma **************
because she is 15 not 50

She needs to get the student visa to convert into a Non O dependent to her husband's retirement non o. You used to be able to apply for Non O dependent visas at nearby consulates which I did for my wife back in 2017. But consulates no longer do this so you need to convert from an Ed visa in country.
Derek *****
Perhaps get a DTV instead?

@Derek ****
if you have DTV can invite family here in thailand?
Derek *****
yes, they have dependent visas for DTV.

I assume your husband has a work visa for Thailand?
Cam *******
Speak to a Thai immigration lawyer or agent to get the correct options for you both 🙏

Can Brown an immigration lawyer?! What for? This ain’t rocket science folks
Cam *******
@Todd ********
maybe not but you never know with Thai immigration. Was just a piece of advice mate. Agent first if no joy then speak to a lawyer. Probably didn't need the ego boosting take down. But hey if your reply made you feel good....

You can get non-O dependent visa if your husband got a work permit. For that you need to have your marriage certificate attestation (MEA).

It would be good if you could contact your nearest immigration office or Thai embassy
Stuart *********
You wouldn’t qualify for spousal visa in the sense that one of the spouses isn’t Thai.

@Stuart ********
but you have to admit, it would be great if one could simply move to Thailand with your spouse and apply for a spousal visa. 🙏

@Michael ******
yes unlike the United States and the people that hate the United States Thailand is allowed and liked and loved because it has border laws and proper immigration laws. So what you're going to be looking for is going to be more of a work visa. But if you think they will sit there and take the same shit Americans do by all means. Try....😇🙏😁

Eric Mullard - so true

@Michael ******
I would argue that would depend on the spouse.
