Hi all, looking for some advice if possible. My girlfriend is giving birth to our baby in 2 months and I’ve recently came back to my home country (in Europe) after my previous education visa ended. I planned on getting a DTV or even another education visa for a year but I’ve been told the parent (father) visa would make more sense. Has anyone had any experience in getting this and would they say it’s easier than the above two mentioned? No hateful or silly comments please, I am genuinely just looking for some help and advice. Thank you 🙏
Answer summary
A user seeks advice on obtaining a visa in Thailand as the father of a forthcoming Thai child. The conversation reveals that obtaining parental rights typically requires marriage, as being on the birth certificate alone may not suffice for a visa or parental rights. Suggestions include pursuing a Non-O dependent visa without the need for marriage, considering marriage for ease in obtaining a visa, and evaluating a Digital Nomad Visa (DTV) for flexibility. Several users share insights on the requirements for these visas, including financial proof and the need for extensions. The discussion emphasizes the importance of proper legal status to avoid complications with Thai immigration.

If you plan to work remotely from Thailand then get the DTV based on workation. The Non-O based on being the parent of a Thai child doesn't allow you to legally do that.

My kid was born in Thailand from 2 Americans so he did not receive Thai citizenship. But your case I imagine since your child is Thai then a family visa is possible assuming you don't want to marry the mom. Otherwise just marry her and get permanent residence

Yeah, don’t hesitate to get married soon. I know it’s probably not in your game plan but you could get a visa based on marriage and you have a kid and that’s about half the cost of a retirement visa… but you get all the ducks in a row cause catching up is difficult. You don’t want to go through the court system….

Robert Eeg The Non-O visa costs are the same, it's the banked money is the difference but that is not a cost as it is always your money

TrustworthyBlueberry160 why don't you want to marry your child's mother and have the child legitimately? Just curious why doing months of courts and extra cost is preferable.

Get a Non- O dependent visa. No need to be married either. Your name on birth certificate.

Marvin Skip von Beesten That may be enough to get a 90 day Non-O from an Embassy/Comsulate but it will not get an in country extension

OP

You will not be granted parental rights to the child unless you are married when the child is born, and your name is on the birth certificate.

If you're not married when the child is born, you will have to go through family court to be granted parental rights. This can take 3-6 months normally and will require you to get a Thai lawyer.

You also have to be a caretaker of the child in order to qualify for continuing extensions. Just having a Thai child (with parental rights) is not enough for extensions by itself.

appreciate the reply mate! so i need to be married when the babys born to basically be accepted for this visa? i had in mind being there when the babys born and my name being on the birth certificate was enough, really appreciate the info tho. I am just going off what ive read online.

TrustworthyBlueberry160 I think being on the birth certificate is enough for a 90-day non-O visa, but it's not enough to live in Thailand. You need parental rights in order to get annual extensions.

TrustworthyBlueberry160 Get the DTV, fly in and sign the birth certificate then go to court to get parental rights. If you aren’t ready to get married, then don’t do it just for a visa. That’s not difficult at all!

Option 2: Fly in on a tourist or exemption, get married then fly out to get a 90 day non-O based on marriage then extend it in Thailand.

moneys not a issue mate hence why I was looking at getting a DTV visa, I just want to be able to come back to Thailand in say a months time on a tourist visa and once my child is born is May/June go and get the Parental visa but I am probably best either getting the DTV or a agent to help as there’s a lot of conflicting info🙏

TrustworthyBlueberry160 just having a child doesn't mean you can stay without doing anything.

You'll need to get a non-O visa, then get an extension every year. You'll have to do 90 day reports, and the extensions will require proof of funds in a Thai bank and the child will have to be with you at immigration every year for your extension.

TrustworthyBlueberry160 I agree 100% with Brandon, all you might get is a 90 day Non-O from an Embassy with your current status

OP
Graham Seal do you know if I need to be married to get this visa or being on the birth certificate is enough mate? A lot of conflicting information online.

TrustworthyBlueberry160 If you did get an in country extension it would only last 12 months then you re-apply every year

sorry if I sound stupid mate haha, new to all this stuff, done visa runs since I was 17 when I first came to Thailand and got an education visa in the last year. It’s looking like a DTV may be the best option as I can work from anywhere but I would like to get the parental visa as I know I wouldn’t need to worry about anything in terms of renewing or leaving the country until my child is 18.
