Can my daughter get a one-year visa extension as my dependent after her education visa expired?

My daughters one year extension based on education has ended and is now on a covid 60 day extension. She has also recently moved schools and the new school is unable to help with a new Ed extension as it’s not an international school. Her original entry visa was a non-Imm Ed visa.

I have recently moved to a 1 year extension based on being over 50. Is it possible to get her a 1 year extension based on being a dependent of myself or does she need a non -o visa first?

Your daughter is eligible to be dependant on you. You need to talk with your local immigration office if she can apply for an extension based on Non-O dependant or a new visa inside the country..

I spoke with koh samui immigration on the phone and they say cannot do if she has an Ed visa. They say she needs to get a non o from an overseas embassy before they can issue an extension based on my over 50 extension. I want to keep her legal but maybe the best way is just let the covid extension she has expire and let her go on overstay.

, sorry about that. Then you need to plan to leave the country once her covid extension is up (means governments consider it's the time of that traveling is no longer impossible).

Now here is a bit off-topic.

Before you decide to let her overstay, you better check with her school if there is any problem with her being on overstay (=technically illegal immigrant) for her to be a student with that school... or consider if it's okay to keep 'secret' for school activities..

You got a couple of options:

1. Do what Ellie suggest and get an extension of stay based on a Non-O dependent for your daughter.

2. Leave her on overstay. Children under 15 do not get fined or punished (but she will eventually need to get her own visa).
