Hi all, asking for a friend. My Thai friend is in the UK and suffered abuse by her husband and will be getting divorced. She applied to renew her spouse/settlement visa but it was refused. She wants to stay in the UK as she has made a life and friends here. What options does she have to stay and appeal? Any help would be appreciated.

Additional Comment. I can see some comments have been removed but it is a shame on a site like this that you have some awful comments being made, referring to people as imported etc. Just from trying to get some advice for a friend who has had a visa affected by being abused I have been made to feel unwelcome. I thought the heavily medicated Trolls were mostly on Twitter. Be kind people. Meeting someone from another country does not mean you are importing a bride or wife. I posted because the site is for Visa advice and I had some good comments for my step daughters Visa. To the Trolls, get a life or take some more medication. It may help with the racist nasty comments. To the keyboard warrior's make the same comments to my face and you will get a different reaction. Sorry admin but you have a few nutters on here distracting from people actually trying to help.

I assume the spouse visa was refused based upon the probability of no longer being a spouse. Unfortunately having an abusive partner who will no longer be in her life doesn’t open up any visa options despite how many friends she has made. It’s time to come back to Thailand and look for a new farang

I would advise first go to citizens advise center. If not good go to see a lawyer I think you have rights!

I don't think many people here will be too knowledgeable regarding UK visas, I mean this is a group designed for expats in Thailand, not for Thai people in the UK. Try doing some Facebook searches for relevant groups who will be better positioned to help you such as:

if you do the groundwork yourself and just use lawyers to present your case to the tribunal and the inevitable appeal hearing you can reduce the costs considerably.

we had similar problems but in adoption,and being a bolshy Scot went to the top ,Phoned the Cabinet Office and asked for Tony,s number, and got through to his Private Secy,after the lower echelons found out I wasnt being pushed around, life went much easier ,

Hey I'm sorry to hear about the horrible comments, your friend should never had had to go through that and she deserves to have a life in the UK without the husband, her freedom should never come down to an abuser. In Australia, the ONLY way a visa can be cancelled is by immigration...I partner cannot just get the spouse visa cancelled..there is a due process to ensure fairness..

There are people here that can help your friend but we need more info. So pm me with the following details and I will try my best. How old is husband, how old is wife, where did they meet, when did they marry, you say she has made a life for herself in UK what does she do, who are her friends, where does she live (own or rented). This info could help get a definitive answer and possibly save her a lot of money.

Finally think that if you marry in Thailand and then divorce what happens to your marriage visa?

She might be able to apply for the destitute domestic violence (DDV) concession. She'll need professional support and advice.

Gateway helpline in Southampton is Pippa - 023 8091 7917 for all domestic violence support services. As someone else has posted, CAB can also be helpful.

Depends how long she was married for how old husband is etc. I have a friend that makes decisions there. They assume from the start that she only married for the visa and look for arguments against. Abuse is a common claim but is usually brought about that the husband was upset she was seeing someone else. Good luck to her though she may be lucky.

This is one of the reasons why men import women from countries where they know the women will then have no recourse. I'm not saying that is what happened here. I don't know either of the parties involved, but it definitely does happen.
