I am working in a reputed company as head of the dept. My contract is valid till 31 May and visa ending on 04 June 2025. Recently I moved my family to Thailand on Non O, 3 months visa which is ending on 07th April. Now to get the extension I need documents from the company which they are denying as we have mutually agreed to part ways after 31st May. I have tried to change the visa from Non O to Non ED via school where I have enrolled my kids but they are saying immigration cannot transfer Non O to Non ED without exiting the country and coming back either on tourist visa which is not feasible due to the high cost.

What are my legal options? I m still the employee till 31st May and cannot get the new job before that so I cannot sponsor my family which is a bit stressful. Isn't it against the basic human rights?

The company is refusing to provide necessary documents for the extension due to a mutual decision to part ways. The user is exploring options to change from a Non O to a Non ED visa but is facing challenges due to immigration rules that require leaving the country to make this switch. The comments provide insights into legal language regarding visa categories, extension rules, and suggest finding new employment to facilitate a smoother transition.

If you are on an extension of stay rather than a visa (check in your passport) then you have to cancel your work permit and extension of stay the day you stop working and immediately leave the country. You might be able to get a 7 day stamp from immigration giving you that extra time to leave. If your family are still on the initial 90 days visa they can stay until that expires, even if your company provided documents for them to get an extension it would end when you stopped working. And yes you can only switch to an ED visa inside Thailand if you leave and return on a tourist stamp, but your family would still have issues. The simplest thing for you would be to find a new job starting immediately your current job ends and have both employers work together to facilitate a new extension of stay under the new employer on the 31st May
