Do you have a DTV or did you last arrive on a 60 day visa exemption. How long are you planning to stay, do you have a confirmed onward flight or return flight home? 5 day overstay is not good, never over stay, keep a perfect record. If you happen to get arrested it could easily count against you.

Always remember..keep a perfect immigration record and never have any problems. Anyway up to you

I would not take the risk, it depends on the officer you will get. Buy a TR visa, it is not that expensive.
