How can I extend a Non-O spouse visa in Thailand, and do I need a Thai birth certificate?

Hi guys, have somebody experience with extend a non-o spouse visa in Thailand? Can I do the extension anywhere in the country, and do the birthcertificate need to be in thai from a thai departement?

there's no such thing as a "tourist visa on arrival" 😕

IF you didn't BUY a tourist visa from a thai consulate before you come here if you come from one of the 51 countries you could show up here and get in FREE for 30 days on a visa exempt entry. That could be extended ONCE for 30 days and then again for 60 more days ONCE under the visit family clause.

You don't need to show proof of parental rights to get the 60 day visit family extension.

BUT

I'd say GO to another country and either get a single entry Non-O based on being the father of thai children (no parental rights is needed) OR get a single entry tourist visa while you're there.

Just one more question, hope its not off topic. If I instead of search for a new non-o based on children, is it possible to get a tourist visa on arraival even thu I just had non-o for three months, and after that, visa for visiting children 2 months? Because I dont know how long the processing time is for the Non-o at the embassy in Vietnam.

what Immigration asks from you is a Thai family court decision that grants you the paternal rights for your half Thai children. The birth certificates and the custody documents from another country are not enough. Once you have a family court order, you can go for the 1-year extension of stay based on the custody over half Thai children. The process by the Thai family court might take some time, though

Okay, this turned into a train wreck most due to the O/P not saying exactly what they're doing or trying to do

SO to recap

The O/P entered on a 90 day non-O based on having thai children.

The children were born out of wedlock and that means IF the O/P is gonna use the children as the reason to apply for a yearly extension of stay he needs to get proof of legal parental rights, which you get one of two ways;

go to the amphur with the children if they're old enough (usually 6 or so) and get the decree there

OR

go thru family court and get the decree from the court.

Without having that proof of parental rights a foreigner who has half thai children which were born out of wedlock cannot use them as the reason for their extension.

Another problem was the fact that the O/P mistakenly thought the documentation they showed to get the VISA in a a thai conuslate in another coungtry was the same documentation they needed to get a year extension inside the country at the immigration office.

Those are two completely different processes by two completely different governmental agencies and have nothing to do with one another.

I'd say GO to Cambodia or Vietnam and get ANOTHER 90 day Non-O visa based on being the father of thai children, (again the requirements at the consulates are less than they are inside the country)

Come back get stamped in for 90 days, wait out the time to get the family court decree (that you say is already in process) and THEN apply for the yearly extension

With the (air) borders opening up, it might be worhtwhile to get a multi entry non-O visa from the Ho Chi Minh City consulate. There is no requirement of proof of funds plus the staff are friendly and efficient. I did this in December 2018 and January 2020.

An added bonus is that you can score an extra 90 days by re-entering Thailand on the expiry date of your visa!

i think you might wanna re-think the "go to Lao for a tourist visa" seeing as the country is closed and instead to go to Cambodia or Vietnam"

As you're the father of thai children, you should be able to get a 90 day single entry Non-O visa based on that with just the birth certificates, the mother's thai i/d and her house book listing.

Check the website of the thai consulate in the country you're thinking of going to and see what the requirements are

BUT

Getting that visa will get you stamped in for 90 days when you show up and then you just wait to apply for the year extension after that 🙂

ok 👍 is there any quarantine when going to Cambodja? Yes I can get that, but they want a father certificate made here in Thailand and I have search for that but it will take 45 days to get it 😕

that is not a thai visa question 😕 ,

you need to research the entry requirements for the country you're going to AND the requirements to get a visa from the thai consulate there.

I have just been to the juvenile and family court to get registred as a father of my 3 kids.

But it will take 45 days for them to get me the documents and by then my visa has expired 😕

So I think my best option are to leave for Laos and get me a tourist visa.

Laos is not yet open.

Suggest you look at Cambodia, Vietnam or Singapore.

Hi again, today I went to the immigration here in Thailand to check if I could make a covid exstension, that would had solved all my troubles thus I will get the birthcertificate for my kids on june 20 and from that could search the Non-o family again. But to my suprise I wasent able to get the exstension. Is it because I first had a Non-o for 3 months and then visiting family less then 2 months visa? Or is it up to the officer at the Office to decide?

TM30 is not 90ays report, but the address registration which is usually done by landlord or hotel administrations. Every foreigner who is staying in Thailand for more than 1 night has to be registered.

Thanks for the answers. Sorry but I wrote a little wrong above. I meant a non-o based on family. I have kids that are born overseas but are thai nationals. I came here with a non-o family visa. I was told to use the same documents for the extention after 3 months in Thailand as I used to obtain the visa back home. But I went to the office and they need further documents for me registrated as a father other then the ones I have from the thai embassy. Anyone know where to get thoose pappers?

getting the birth certificate would be simpler I'd have thought. Otherwise the option is to leave, get a tourist visa somewhere and return but at best that's only going to give you 3 months

Okey thanks, yes my kids are here with us.

I came with a non-o family, it expired in March, could not make the existension because of missing birthcertificate from a thai instance, they made me a 2 months visiting family visa instead. That visa is about to expire soon, any suggestions what to do? Can I leave Thailand for example Laos and obtain a tourist visa on arraival? Even thu I just hade a non-o and a visiting family visa?

you have to apply for a 1-year extension at the immigration office that serves the area your address on TM30 receipt belongs.

You need to get the latest requirement from your local immigration office. Here is the general information for extension based on raising a half Thai child. (Edited based on new comment below)

You apply for the Extension of Stay based on being married with a Thai National at the local Immigration Office that serves your address.

You need the marriage certificate next to other documents, but there is no requirement to bring a birth certificate.

Best is to contact your local Immigration Office and ask the hand out with requirements.
