TLDR : Answer Summary
To change your visa status from a marriage-based visa to a Thai child support visa, you typically need a valid reason approved by the immigration office. If you have legal custody of your child, you may inquire directly at your local immigration office. Usually, a switch is permitted if you are unable to meet financial requirements for the marriage visa or if you are in the process of a divorce. Be prepared to provide necessary documentation to support your request.

I had messaged with you before and I sent you some messages about this post. CHECK the messages

I will close this post until I hear from you

Okay, here's how that works.

AS A RULE the immigration office WILL NOT let you just switch to an extension based on children from the one based on marriage unless you have a good reason. (Don't have the funds seasoned 2 months for the marriage extension, in the process of a divorce, etc)

The only reason I usually see them allow the switch is because the person didn't meet the 2 month seasoning on the 400K baht in a thai bank account and that seasoning is NOT required for extensions based on thai children or because you will be divorced shortly.

GO to your immigration office and ask them IF you can switch the reason for the extension, they are the ones that will tell you if you can or can't

What visa/extension are you on exactly?

he does NOT need to, if you have a child when you're married to automatically get parental rights granted AND even if you divorce you still keep them unless you relinquish them in the divorce decree. There is no need to get parental rights decree

but I am not divorcing. That's the whole point of this post. Can I change visa status or not? If so what's the process if anyone knows. Please don't speculate. If you know advise, if not please don't waste your precious time. Thanks.

, If your child was born in your marriage with a Thai mother, you can apply for your next 1-year extension with a new reason (changing the reason for the extension). Prepare the documents required for an extension based on raising a Thai child. Go to your local immigration to get the latest handout of the requirements for that extension.

Here is the general list of basic requirements, but details would vary for each office.

And be prepared to explain why you want to change the reason when you are asked.

visa based on marriage to a Thai citizen. I have 2 children. Girl 9 and boy 19. Both Thai. I am not divorced. But I want to change to visa based on child support. Instead of marriage. Thanks.

I am residing in Thailand since the last 5 years. Both the children are from our marriage. I am the father by their birth certificates. I have been renewing my visa every year based on marriage. Now I want to change to child support visa. Any kind of positive assistance will be highly appreciated. Thank you kindly. God bless.

And your children are from your current marriage (born after you got married to your current Thai spouse)?

do you mean you have visa sticker/PDF from Thai embassy/consulate and entry stamp, OR you are applying for 1-year extension from initial visa at the local immigration office?

Do you have legal custody of the child, awarded by a court?

no I don't.

Sorry, then you won't get an extension of stay based on your child, (other than a 60 day visiting family one).
