Hello all,

What is the earliest you can generally apply for the first 1 year extension of a Non-O ME based on marriage? I will be using proof of monthly income at Buriram office. TIA!

TLDR : Answer Summary
You can generally apply for a 1-year extension of your Non-O visa (based on marriage) 30-45 days before your current entry stamp expires. However, since you are currently under amnesty due to the expiration of your entry stamp, you can apply anytime before the amnesty period ends on September 26. It's advisable to check with the Buriram Immigration office regarding the required documentation for proof of funds, especially if you are using the monthly income method.

Thanks everyone for the good information. So putting that all together you can "generally" apply for a 1 year extension 45 days or less before your last entry stamp expires. However, as I am on Amnesty I SHOULD be able to apply anytime now, the earlier the better.

I am inquiring because I visited Buriram Immigration early August to inquire about this as I may have to leave the country for work sometime in the near future and might only be able to get back after my Visa expires Oct. 24th. I would like to have this extension sorted before leaving as it would be one less headache when I have to look at getting back. The Captain seemed shocked that I would want to get a 1 year extension now and basically said, cannot now come back before visa expires or get new visa or come back on a visa exempt stamp. None of which I want to do ๐Ÿ˜‚

I would say the person you talked to was wrong and you can apply for a new extension anytime because you're not on ANY entry stamp :O

In fact looking at your passport would show you're on overstay from your last entry :O (because all amnesty is, is waiving the penalties and fines to let you overstay legally).

Meet the requirements and you could apply for the yearly extension any time between now and the 26th of Sept,

BUT

I'd sure think long and hard about leaving thailand because while you can get OUT easy enough you sure aren't gonna get back in easy or fast or cheap :(

Good Luck,

Because you are using monthly income method to meet the proof of funds, I'd say go to one of the two Buririam Immigration offices BEFORE you need to apply and make sure you know the correct documentation needed to use that method to show proof of funds. The last thing you need to do is show up there to apply and not have the required documentation

As
@El***
correctly stated you can apply for a yearly extension when you have 45 days or less left on your current entry stamp (the validity of your VISA sticker has nothing at all to do with you applying for an extension because a visa doesn't let you stay IN thailand, it lets you ask to get in and it's the small blue rectangular entry stamp you got when you entered using that visa that actually lets you stay here)

Seeing as your 90 day entry stamp expired MONTHS ago, and you're on amnesty you can apply for a yearly extension anytime from now until the 26th of Sept <- the day the amnesty you're on now expires.

If you say "generally", at the most immigration office you can apply for a 1-year extension 30days before your CURRENT admitted until date. Some offices allow you to apply 45days before or less.

Are you currently on an extension of stay based on marriage?

@Benjamin *****
No, this will be my first extension. I am currently on amnesty until 26th September with my Non-O expiring 24th October.
