I have a question related to the retirement visa. My husband is planning to apply for the 1 year Non-O retirement visa from within Thailand. Do you know if this visa allows for followers, which would include a spouse and child? or would he need to apply for the long term 5 year Non-OX retirement visa? Thank you for your help!

TLDR : Answer Summary
The 1-year Non-O retirement visa does allow for dependent visas for a spouse and child, but specific rules apply when applying for these dependent visas. The primary visa holder must first obtain a 90-day Non-O visa and then convert it to a 1-year extension before the spouse and child can apply for their Non-O visas. This must be done at a nearby consulate, such as in Penang, as initial applications for dependent visas cannot be made from within Thailand based on the husband's retirement status.

To emphasize one of the important points Tod stated, you cannot apply for your non-O visa at Penang until after your husband is already on the 1 year extension. Him just having the 90 day non-O visa that he converted to is not enough. You would have to wait until he has the full extension first.

The answer will seem convoluted, but yes that visa does allow "trailing spouse/child" matching extensions

BUT

with that being said you cannot get the initial 90 day Non-O visas based on being a trailing spouse or child issued INSIDE thailand based on the primary visa holder being on retirement.

You would have to have the husband get his 90 day Non-O visa and year extension THEN you'd have to go to a nearby consulate (Penang seems to be the only one in the area) to get the 90 day Non-O visas for the spouse and child.

Once you got those and there was less than 30 days left on the 90 day stamps you'd get when you entered you could then apply for a matching extension to your husbands 'retirement' visa/extension providing you met the requirements

Thank you so much for your help! Just to clarify/confirm, my husband and I are both currently on ED visas, and our son is on a Non-O trailing visa, and if we hope to switch to a retirement visa (ie my husband would be on the retirement visa and my son and I would "trail" him), He would need to apply for the retirement visa in-country, my husband would have the retirement visa for 90 days and at his first extension, then we can begin "trailing" on his visa but can only apply to do so from a different country?

, you are right. You and your son need to go to apply for your first Non-O visa based on being a trailing family member at the embassy/consulate in another country when your husband on an 1 year retirement extension.

This is totally unnecessary additional, it might be worth to contact Penang or another consulate to see if all of you can apply for initial visas (one retirement + two trailing family) at once there.
