Hello, I have a question about my husband visa (I am thai). He entered in Thailand on visa exemption and this will end on 17th april. We are doing all the process to get married (the municipality must call me next week).

Can he extend for 30 days and then switch on non-o for 90 days?

Thanks!
Answer summary
The user inquired whether her husband, who entered Thailand on a visa exemption, can extend it for 30 days and then switch to a Non-O visa after their marriage. Comments clarified that he can typically extend his visa exemption once for 30 days. However, to switch to a Non-O visa based on marriage, he must be legally married and submit necessary documents, including proof of funds. If the marriage isn't completed in time for the visa switch, he may need to leave Thailand and apply for a Non-O visa at a Thai embassy abroad. The importance of timing and having the proper documentation was emphasized.

You didn’t mention your husband’s nationality, which actually matters a lot here because visa rules and options can vary depending on the country. It makes it harder for people to give precise advice.

That said, in general:

Yes, he can usually extend his visa exemption once for 30 days at immigration (before it expires on April 17).

After that, switching to a Non-O visa (based on marriage) inside Thailand is possible, but there are a few important conditions:

• You must already be legally married (not just in process)

• You need all required documents ready (marriage certificate, financial proof, etc.)

• Immigration typically requires that he still has valid stay remaining when applying

If the marriage isn’t finalized in time, he likely won’t be able to convert directly and may need to leave Thailand and apply for a Non-O visa from a Thai embassy abroad.

So timing is key here—if the marriage happens before his extension ends, you’re in a good position. If not, plan for a visa run.

he is married with Thai woman. And they are a couple. so, his nationality makes different rules?? he will get Thai married visa, this family visa is differentiated from husbands nationality??
Milan *******

Young Nationality doesn’t change anything here. If a foreigner is legally married to a Thai woman, he applies for a Thai marriage visa/extension—same rules whether he’s Belgian, American, or anything else.

People sometimes call it a “family visa,” but it’s still based on the marriage, not the husband’s nationality. 👍

Proof of income is required, a pension notice or Like. Depending on the age and country in which the message is located, a few things can be requested. At least the Khor Ror 3, the wife's passport copy, registration form.... since you are only short Married, the documents are new and securely certified by Thai Foreign Ministry and the Embassy of the Homeland. and a lot. You don't need more for that.

Nancy Van Rysselberghe no. My first step was to visit bangkok to my uk embassy to aquire, a freedom to marry affdavit , everyone must do this first. He will recieve a certificate. You need to book a appointment at his embassy first and pay the fee online. Once you have the certificate, you need to visit a translation service to translate the certificate to his language, we paid 6000 baht and they got it all excepted and legalized at the goverment mfa department. This took a week and they posted it to us back in issan. Then your free to register the marraige. Our small aphue could not do it for some reason so this morning we go back to bangkok to pay a agent to help us register which is costing

and were done just in time to apply for non o visa as you must apply 15 days before his extension expires.

Jason Bracegirdle thank you Jason. We Will do that. And then, he must go out of the country at the end of his extension and apply for a non-o from a thai embassy in border country? Is that you did?

Have to do the premarital certificate from his embassy or consulate in Thailand and get it translated then registered marriage in Thailand. You can then apply for a 90 day non o marriage visa which gives you 30 days to open and fund a Thai bank savings account. You can then apply for the year extension if you made the 400K deposit and meet the requirements of your local immigration, they all have their own interpretation of the rules so it’s important to ask them what they need.

Nancy Van Rysselberghe Can I convert a Tourist Visa to a Marriage Visa in Thailand?

Yes. You can enter Thailand on a tourist visa and, after your marriage, apply to change your visa status to a Non-Immigrant O visa based on marriage, subject to immigration requirements.

If you later meet the requirements for a longer stay, you may then apply for a one-year extension of stay based on marriage at your local immigration office.

Do I need a Non-Immigrant O visa before I can marry a Thai national?

No. You do not need a Non-Immigrant O visa to get married in Thailand. You can enter Thailand on a tourist visa or visa exemption, register the marriage, and afterwards apply for a Non-Immigrant O visa based on marriage.

What is the typical process after marrying a Thai national?

Many applicants follow this general sequence:

Enter Thailand (tourist visa or visa exemption).

Register the marriage in Thailand.

Apply at Thai Immigration to obtain Non-Immigrant O status based on marriage (where available).

Open a Thai bank account (requirements vary by bank/branch).

Deposit 400,000 THB (for the marriage extension).

Apply for the one-year extension of stay based on marriage.

Do I need 400,000 THB in the bank before applying for a marriage visa?

No. The 400,000 THB financial requirement applies to the one-year extension of stay based on marriage, not to the initial visa application. In practice, many people open the account after they have Non-Immigrant O (marriage) status.

Can I apply for a Non-Immigrant O visa outside Thailand?

Sometimes, yes. Thai embassies/consulates abroad may issue a Non-Immigrant O visa, but requirements vary significantly by location and can change. Approval may also depend on the reviewing officials.

Can a support letter from my Thai spouse help with a Non-O visa application?

Sometimes. If you apply for a Non-Immigrant O outside Thailand (including before the marriage), a short support letter from your Thai spouse (or future spouse) can sometimes help in addition to other supporting evidence (for example, spouse ID/house registration copies, proof of relationship, travel/accommodation details, and proof of funds such as bank statements).

Important: There is no guarantee this will be accepted. Requirements and decisions can vary by embassy/consulate, location, and the reviewing officials.

This is from Thai law online, my power has gone out so had to do a phone google and it matches with the basic requirements but photos required can vary between 2 and 10 or more depending on the office used. It would be nice if it was the same everywhere but it is Thailand.

Jason Bracegirdle it is not best to leave it until your last week to get your extension unless you use Jomtien Immigration where this is a requirement

Your future husband should not be afraid to spend some time in a neighboring country to apply for the visa which will fit his new situation after he gets married. But, before that, he can do an extension of 30 days.

Does he already have a Thai bank account? He would need to be able to show 400,000 in his Thai bank account in order to apply for a non-O visa based on marriage at an immigration office.

I believe most immigration offices also require you to have already been married for at least 2 months before they'll allow you to apply for a non-O marriage visa inside of Thailand. Which means he will likely need to leave Thailand. It would be best to apply for the non-O visa from a Thai embassy during that time.

@Brandon ***********
no because he entered on exemption as a tourist so can’t open a bank account.

He must have first non-o visa right to open bank account, put 400k for 2 months and then ask for the extension of 12months?

I didn’t know that there was a minimum period for asking non-o after getting married.. we are based on Koh phangan, I will try to go ask to the immigration there hope he doesn’t have to leave the country 🙏🏼

@Nancy ******************
he cannot do it without leaving because he doesn't have a Thai bank account. No Thai bank account, no non-O visa. He must be able to show 400,000 in his Thai bank account to apply for a non-O visa in Thailand.

His ONLY option is to leave Thailand and apply for a non-O visa from a Thai embassy after you're married. He can show funds from any bank account for the embassy. Then when he returns he can use that non-O visa to open a bank account and deposit the funds required for the extension.

if his embassy in Bangkok still offers that, it's a possibility then. But he'll still run into the issue of not being married long enough to get the visa.
