Can I switch a 30-day extension to a one-year visa based on marriage before it expires?

Hi, I am from the UK. I have already been granted a 30 day extension with embassy letter. I would like to know if I can switch this to a one year extension of stay based on marriage if my Thai partner and I get married before this extension finishes on 25th October.

Alternatively, if I get a 90 day extension based on medical (34 weeks pregnant) can this theb be switched the same way.

We were hoping to get married later in the year and we need to know if we have to rush it.

Thank you for any advice.

TLDR : Answer Summary
The user from the UK inquired about switching a 30-day extension of stay to a one-year extension based on marriage before the current extension expires on October 25. They also asked if a 90-day extension based on medical grounds could be switched similarly. Responses indicated that converting the current extension to a long-term marriage visa isn't possible until after marriage, and that a medical extension can be granted up to 90 days but is subject to specific procedures with immigration.

Then NO, you can't apply for a year extension of stay straight off a 60 day tourist visa entry that went to amnesty.

You first need to apply for a 90 day Non-O visa based on marriage to a thai and for you to do that you need to be married ;) You're not, so for now that's off the table.

As far as a medical extension of stay that's between you, the doctor/hospital you use and the immigration office. An extension based on medical reasons can be issued for up to 90 days at a time.

Quite right, I did mention that we were already planning to get married later on and the point of the post was to know whether we need to bring it forward due to the visa. I don't need to be married to get a visa as I will soon have a Thai child.

Hi, thanks for your comment. I need to get parental rights even though I'm the mother? I didn't realise that.

Once you DO get a medical extension of stay you COULD then use that hard stamp extension to apply for a 90 day Non-O visa based on marriage and then after that apply for the year extension.

GO to your immigration office and get the hand out that lists the documentation requirements and the time needed on an extension stamp to convert to a 90 day Non-O visa inside the country. Most offices require you to have 15 days or more left on your current stamp to do the in country conversion (Chiang Mai requires 21 days).

Thank you for your helpful advice. The British Embassy advised me to get married before 26th October but it seems that is not actually necessary?

I couldn't comment on why they said that
@D**
. You said you're going to apply for an extension based on medical reasons.

Yes, due to being 34 weeks pregnant. They said it would be better to try to get married quickly and skip the medical part but I was hoping to do the medical first and get married later

that's a decision you have to make.

I don't think you have enough time to get married on this current 30 day embassy request extension and then apply for the in country 90 day Non-O visa (although that's a decision you need to make AFTER talking to the immigration office to find out how many days you need left on the stamp to apply for the visa)

That means your options are:

get married, apply for a 60 day visit thai family extension, use that time to apply for a 90 day Non-O visa, then apply for the year

OR

get the 90 day medical extension, get married, apply for the 90 day Non-O then apply for the year.

What visa or entry stamp did you come IN to the country on before it locked down back at the end of March?

Oh yes I forgot that after my tourist visa finished I went out of the country and came back on 30 days, which was then extended for another 30 days. Then I went on to amnesty. Does that make a difference?

well, I think Tod Daniels was under the impression you were here on a single entry tourist and advised as such.

There have been so many twists and turns Iโ€™m not 100% certain but Iโ€™d think yes, it may make a difference.

Tod will be sure to know so you might want to ask again and update him.
