Can I Skip Legalisation by MFA for My UK Marriage Certificate for Thai Visa?

am a Brit, married to a Thai (we married in UK) & I wish to join her in Thailand by obtaining Non-O Marriage Visa conversion from a SETV. I will probably preface this with SETV s + a 60 day “Visiting Family” Extensions – giving me a stay of 120 days each time - until such time as we have all the other requirements (particularly the financial requirement) in place for the in-country 90 Day Single Entry Non-O based on marriage to a Thai, and then the 1 year Extension of Stay.

We visited the Immigration Office in Suphanburi to get the list of requirements etc. They were very helpful, and yes, they do this conversion in Suphanburi.

The first step is the get our UK Marriage cert legalised. As I live in London I can do this via the FCO Legalisation service by post and then take that and the translation (which we have already – done in Bangkok) to the Royal Thai Embassy in London for them to legalise/certify the Translation. Immigration Suphanburi confirmed that this acceptable and they do not need the additional legalisation/certification of the MFA in Bangkok.

They also confirmed that on their list of requirement was the Kor Ror 22 – Registration of an overseas marriage with the local Amphur. I assume that the Amphur will require the same legalisation/certification of our marriage certificate as indicated above. This appears to be a “Belt & Braces” situation as far as supporting documentation is concerned. We will check the requirements at the local Amphur. The IO had printed out a list of requirements (in Thai only) for the 1 year Extension of Stay & under Item 6 Kor Ror 22 it appears to say that each time a new extension is applied for a new Kor Ror 22 is required. This seems odd as once the overseas marriage is registered locally it remains registered.

One of my questions for the requirements for the in-country 90 Day Single Entry Non-O based on marriage was to confirm that it should be applied for within the last 15 days of whatever permitted to stay date I currently have, and the THB 400,000 required (deposited in a bank account in my name) does not need to be seasoned (as it does for the 1 year Extn) and that they do NOT require proof of origin of the funds to be from overseas – income locally derived is OK. IO so confirmed but this last item is contrary to what I have read on this site and so I specifically asked again in Thai (via my wife) & in English (the lady IO spoke some English) and she confirmed that the 400,000 can be locally derived.

The IO also stated that if we were going for the monthly income to fulfil the financial requirements then the amount was THB65,000 per month whereas the figure I have seen on all the documents online is 40,000 per month, & 40,000 pm is on the handout (in Thai) that she printed off for me. This is not the route we will take but I add it out of interest.

So, Three Questions:

1 Legalisation of Marriage Cert: Can we indeed do without the further certification of the translation by the MFA in BKK, having got it from the RTE in London? Or is this a dispensation from Suphanburi?

2 Is the Kor Ror 22 required in addition the legalised/certified UK Marriage Cert + translation? Or is this a specific requirement for Suphanburi & if they want it we just have to get it? And do we need a new Kor Ror 22 each time I apply for an Extension of Stay or is this just an updated one with a new date stamp? Reading elsewhere on this forum indicates that yes, you need to update/get a new KR22 each time you apply for a yearly Extn as this proves that you are still married & at THB20 a go that is the quickest/cheapest option.

3 Can the THB400,000 deposited for the Non-O based on marriage be locally derived? Or again is this specific to Suphanburi and if so can they do this?

I am concerned about "it’s local Amphor for name change and change I’d card" as my wife's Thai & UK Passport are in her maiden name (as is her Thai ID card) and I am 100% sure she does not want to change them. Can the KR22 not be issued in her maiden name?

for a thai changing the name is TOTALLY optional. There is no obligation that she take your surname at all.

We recently did all this it’s a bit of a marathon send the Uk marriage cert to fco for legalisation then when we got to Thailand the certificate went off to Bangkok to be translated then it’s local Amphor for name change and change I’d card after that if she has a passport it’s off to Bangkok for new passport

There are 70+ immigration offices in the country SO if the one you are dealing with CAN indeed issue an in country 90 day Non-O visa based on marriage go with the requirements they tell you.

Seeing as you are going banked money method don't worry about the officer telling you the wrong amount that would needed to be transferred into a thai bank account every month.

You do that legalization of the marriage certificate from Milton Keyes and the thai consulate in the UK

As far as what will be required to get the Kor Ror 22 (the document from the Amphur that says a thai was married abroad) that will vary Amphur by Amphur SO once you get your marriage certificate legalized THEN go to the Amphur and check to see what they want. You MIGHT still have to get it translated into thai and certified by the MFA office here in thailand for the Amphur to issue a Kor Ror 22

You are confusing a Kor Ror 22 (thai married abroad document) with a Kor Ror 2 (thai married in country). AFAIK you do NOT get a new Kor Ror 22 every year.

Follow what they are telling you. It doesn't matter that in bangkok you must show the funds came from abroad and there's no seasoning on them when applying for the 90 day Non-O visa IF the immigration office you deal with says it doesn't matter.
