TLDR : Answer Summary
The user inquired about obtaining a work permit while holding a Non-O Visa based on marriage in Thailand. Responses indicated that it is possible for the company to apply for a work permit, and that they must also adhere to the 90-day reporting requirement or apply for an Extension of Stay. It was noted that while the Non-O and work permit are independent, they cannot be held simultaneously, and careful consideration must be given to visa status and documentation.

AFAIK all Ministries of Labour will issue a work permit to someone on a visa or an extension of stay based on marriage.

@Ma**
, the company you're going to work for will apply for the work permit at the Ministry of Labor.

Ok i understand this. I was alittle confused about the comments before about me still having to leave the country every 90 days. My visa is valid until november time and im due for my 90 day border bounce mid april. If i start working at the start of april do we know the procedure? Do i still need to exit/enter every 90 days with a work permit?

you can never renew any visa :/ You would either go to a thai consulate and buy a new one, or you would go to the immigration office and apply for a yearly extension of stay by meeting the financial requirements of

-400K baht in a thai bank account in your name for 2 months before you apply for the extension

-a notarized letter from your consulate stating you get 40K baht a month in income

-three months of pay stubs and tax receipts and documentation from the company you work for showing you have at least a 40K baht a month salary

The good thing about having a non O based on marriage and work permit is that they are not tie up together. So even if you cancel your work permit, your stay in thailand depends on the non O or extension of stay based on marriage expiry instead.

Hi andre. Do have have work permit based on non O? Do you know the procedure to apply?

Yes, your company can apply for the work permit. Yes, you still have to leave every 90 days or apply for an Extension of Stay based on marriage or working at local Immigration Office 30 days before your Admitted to Stay period is ending.

If i keep the visa now and do border runs every 90 days ,at the end of this visa do you know if i can apply for a new non O visa based on marrige with a salary of 40k together with my work permit.?

Right ok. Yes understand.

You can't have both, or do the border runs every 90 days, last one on the enter before date of the visa to get maximum stay out of the visa OR apply for Extension and report at Immigration every 90 days.

Ok...but this will mean i will lose the 1 year non O based on marrige visa?
Robert *******
Yes, you understand correctly. You can apply for Extension of Stay 30 days before Admitted to Stay date on every entry of you current Visa. As soon as Extension of Stay is approved you Visa will be invalid, you need to do the 90 day reports and need a re-entry permit when travelling to keep the Extension alive.

Hi
@Robert ******
...so as i understand in your reply.

Once i receive the work permit i will need to extend my current visa for 1 year even tho i have 8 months left on the current visa. And this way i can then do the 90 day reports rather than doing border bounces.?

Ok thank you.

No, your company have to provide you with some documents, for example, tax and social security payments for 4 Thai staff and yourself. You need minimum salary of 40.000 Thb a month unless you are an English teacher. For the correct requirements you can just ask you company or visit with them the Immigration Office in your area. The Extension of Stay is for 1 year and you only make 90 day reports at the Immigration Office.

Hi robert...ok so your saying that after 60 days i can go to immigration and ask for a extension of stay rather than leaving the country and getting stamped in again.? And i would have to do this every 90 day period.
