Question, I have a non immigrant o visa 1 year multiple entry. And an employer to get work permit through, can I apply for work permit on the multiple entry or do I need to upgrade to the 1 year non immigrant o visa first(visa for with reporting, not multiple entry).

The Thai embassy in my country told me it was fine to get the WP just on the multiple entry visa, just want to see if anyone has experience with this.

Thank you!

TLDR : Answer Summary
The conversation addresses whether one can apply for a work permit using a one-year multiple-entry Non-Immigrant O visa. Users confirm that it is possible to hold a work permit on this visa based on marriage, while also exploring options for transitioning to a non-immigrant B visa if necessary. Suggestions include border runs or applying for extensions based on the marriage in Thailand, but advise caution as requirements can vary by specific case.

You a couple choices,

stay on the year-long multi-entry Non-O and border bounce every 90 days like you have

apply for a yearly extension of stay based on marriage by meeting the 400K baht banked for 2 months in thai account in your name OR by showing an affidavit of income from abroad notary letter stating you get 40K baht a month in income

OR

get paperwork from your company to go out of the country and get a new 90 day single entry Non-B and then apply for an extension of stay based on employment.

So just to recap, best way forward without transferring money from home country to Thailand is get work permit with ME Non-O, work for 3 months and then apply for stay based on marriage

don't mix up the requirements to get a VISA from a thai consulate outside the country and the requirements to get a yearly extension of stay from the immigration office inside the country. Those are whores from different go-go bars :O Sorry I mean horses of a different color (I mix up my metaphors sometimes :( )

For the extension you bank the 400K baht in a thai bank account in your name only for 2 months before you apply for a yearly extension OR you go to your consulate and get a notary letter stating you get 40K baht a month in income OR if you legally work here with a work permit you show 3 months of tax statements showing you get over 40K baht a month. Those are the only ways to meet the financial requirement to get a yearly extension of stay inside the country at the immigration office.

Or does it have to be in Thai bank account

Thank you very much for all the info. One last question, about the 400k, I have it in Canadian bank account, and was used to approve the 1 year O visa, can I just submit the same bank statement, or does it have to be verified through my embassy?

yeah that makes sense

There are advantages of either staying on the current Non-O where you border bounce OR getting a yearly extension based on marriage because IF you were to switch to a Non-B visa and extension and you lost your job you'd lose your extension right then.

On the Non-O or the yearly extension if you lose your job you'd still have either your visa or your extension because they were based on marriage not employment.

That answers all the questions I had

you can indeed hold a work permit on a year-long, multi-entry Non-O visa based on marriage (y)

I know I can get the work permit, just seeing if I can skip the one step, and then get the one year reporting visa based on occupation which I will have to anyway

Based on marriage

Capital will be a min of THB 1mill and 2 thais per foreigner. Your employer needs to submit 2017 closing of account, last 3 months SSO paid for Thais, last 3 months of PND1 if they are paying taxes too. A simple CV will do. Based on marriage to a Thai.

Correct, I think the requirement is about half of the capital and staff requirements. However don't take my word for it. Perhaps someone else can confirm.

Does the company still have to fulfil all the same requirements as a work permit for the non-immigrant b holder? I had one person tell me that because it's based on marriage it is a bit easier of a process with less limitations on the work permit holder
Troy ********
Yes I have one based on marriage. You can just get a work permit and start working. No problem.
David **********
OK then maybe they are correct, I am not familiar with the marriage visa, but sounds right

Is the Non 0 based on being over 50?

If so? then you can't work on that visa. Also it's not a 1 year non0 based on over 50, it would be a 12 month extension, I'm pretty sure you need a non b visa and work permit to work in Thailand.
