So I know you can get a work permit on a Non-O visa based on marriage to a thai, but can you get a work permit on a Non O based on marriage to a Non B?

I have a Non B as a teacher, my husband has a dependent Non O. If he gets a job can he get a work permit on his Non O, or does he have to leave the country and get a Non B?

TLDR : Answer Summary
A Non-O visa holder, who is in Thailand based on marriage to a foreign national, is not eligible for a work permit. This visa type is considered a 'trailing spouse' visa, which prohibits employment. To obtain a work permit, the individual would need to switch to a Non-B visa. This can be done by either exiting the country and applying for a Non-B visa at a Thai consulate or by applying for a 90-day Non-B visa while already in Thailand, provided their employer meets the necessary requirements.

Nope, that's the notable difference between those two non-O subcategories. So he will have to go abroad and get a non-B, or switch to it in-country if the employer can qualify for that.

He cannot ๐Ÿ˜• ,

The Non-O visa/extension based on being married to a foreigner who legally works here cannot get a work permit or be employed. It's a "trailing spouse" visa with employment prohibited

They'd have to cancel the extension they're on, and then either bounce out/back to get on a free stamp entry where they could apply in country for the 90 day Non-B (If their employer can meet those requirements)

OR

they'd cancel the extension they're on, exit the country, go to a thai consulate nearby and get the 90 day single entry Non-B visa
