If I am married and my spouse has a job in Thailand, would that allow me to move to Thailand with a spousal visa?

TLDR : Answer Summary
If your spouse has a job in Thailand and holds a Non-B visa, you can apply for a Non-O visa based on your marriage. This spousal visa allows you to stay in Thailand but comes with specific limitations: you cannot work while on this visa, and your residency will depend on your spouse's employment status. If your spouse loses his job, you will both be required to leave Thailand.

Okay, lets try to get this back on track
@Son****
is married to a foreigner who will come here on or come here and get a Non-B visa based on being a teacher.

That means she will apply for a Non-O visa based on being married to a foreigner who legally works here.

That Non-O visa/extension is called "trailing spouse". AND on that visa she cannot work inside the country.

I would say that BOTH her and her husband should get their visas from the thai consulate in the country they're in BEFORE they wing their way here. The husband gets a 90 day Non-B visa based on employment and SongFee gets a 90 day Non-O visa based on being the trailing spouse.

It totally goes without saying BUT I will say it that both you and your husband will need to meet the entry requirements in place to get IN to thailand after you get the visas from the thai consulate <- that means you'll both need 100K US dollars of covid insurance, you'll both need negative covid tests, both need 14 days booked quarantine and both need Certificates of Entry.

>would that allow me to move to Thailand with a spousal visa?

[ I'm assuming your husband is a foreigner. Disregard this comment if he's Thai]

Yes it would. However, would this be the best option for you? I don't know.

1. You *CAN NOT* work on a extension of stay based on being a trailing spouse.

2. Your rights to stay in Thailand will be connected to your husbands'. If your husband loses his job, you and him will both have to leave at the same time.

3. Theres' a possibility you can not get an extension of stay that allows employment on this visa, because the original visa does not allow employment.

I am confused on number 3. Is it the same as number 1?

@SongFee *****
no, number 1 is saying you can't work on that extension of stay. Number 3 is saying, if you find a job here, that there is the possibility you won't be able to convert to an extension of stay based on employment...at least not without having to leave the country to do so.

Yep, IF your husband has a Non-B visa/work permit based on employment you could get a 90 day Non-O visa and then an extension matching his based on being married to him.

is there a reason to apply for the 90-day visa versus the 1-year in this case? If the consulate/embassy offers both, why the 90-day? I'm in the exact same situation and was going to apply for the 1-year.

Ben Shalom...me too...got 90 days

Thank you! Makes sense. Glad I asked before applying😊

@Rac***
just so you're clear that one year multi-entry visa only gets you stamped in for 90 days then you exit/re-enter to get another 90 day stamp. It's totally worthless right now with covid and the quarantine requirements in thailand and neighboring countries. Get a 90 day single entry non-O and then apply for the in country extension

sorry and what quite is a non-O visa?
Wannikea *********
@SongFee *****
non O is a category of visa that can include reasons such as retirement, marriage, dependant etc

@SongFee *****
, it is a visa issued to people for OTHER reasons (marriage, retirement, etc) you need to go to the thai consulate in your country and read about the requirements to get a 90 day Non-O visa before you come here

@SongFee *****
First step is that you have your husband talk to his employer. You would need documents from his employer to apply for your Non-O.

great’ I will check with him. With a 90 day Non-O visa, I would still need to get insurance for COVId correct?
Wannikea *********
@SongFee *****
yes to enter Thailand you'd need insurance covering the 90 day term of the visa
