Can I leave Thailand while my Non-O visa application is being processed, and can I use a different address for my application?

Hello all, I have a question about the non-O visa (my male fiancé is Thai). From what I understand, first I receive a 90 day extension, and after that I can apply for a 1 year extension. My question is, can I leave Thailand during the processing time? For example, traveling elsewhere in Asia or home to the States. Also - do I need to stay in the same place in Thailand during the 90 days + 1 year? Could I use his parents address in Bangkok? Thanks!

TLDR : Answer Summary
The Non-O visa is issued based on being married to a Thai citizen, and the application process includes first obtaining a 90-day visa, followed by a yearly extension. It is crucial to remain at the address registered during this period, and if using a different address (such as a family member's), it is necessary to file a TM30 to verify residence. While your application is being processed, typically you cannot leave Thailand; however, once you have received the visa, there are options to travel.

You need to PROVE you live in the area where you're applying for the Non-O visa/year extension. SO if his parents address is where you live get a TM30 filed showing you live there and you can use that address and apply in Bangkok

You aren't gonna get ANY Non-O visa until you're actually married to a thai, they aren't issued because you intend to get married ;)

What will happen is you get married, THEN you go to apply for the 90 day Non-O visa at your immigration office based on marriage to a thai. It will go under consideration for usually 14 days and then you go back and get the Non-O visa and a new 90 day stamp inked into your passport

THEN you wait until you have 30 days left on that stamp and go back to the immigration office to apply for a year extension based on marriage to a thai. You will get a 30 day under consideration stamp (and during that time they will come to your house for an in home visit) then you go back when that under consideration stamp runs out and they will put the year extension in to your passport

Thank you
@Tod ********
! You are truly so kind to be helping strangers through all this bureaucracy. My final (hopefully) two questions... first, when you say buy a re-entry permit, do you mean applying for a more expensive re-entry visa? Or is there a different process? And second, what about traveling within Thailand?

@Tod ********
thank you! We are planning to get married ASAP! So during the first 90 days, do I need to stay in the same location in Thailand? Can I leave Thailand? What about during the 30 days before the year extension?

@Er**
as I said ONCE you get the 90 day Non-O visa issued you would BUY a re-entry permit and you could leave the country as long as you came back before that 90 days was over so you could still apply for the year.

AND

My advice is DON'T travel at all and wait until you get the year extension before you do.

You are free to do what you want..

You can't travel at ALL after you apply for the 90 day Non-O visa while you wait the 2 weeks (you have to be on the same entry stamp when you go back to get the Non-O and 90 day stamp inked in)

You could travel outside the country once you got that 90 day Non-O visa IF you got a re-entry permit and came back before the 90 days ran out <- other wise you'd lose the visa/stamp and start all over.

Same with the year extension when you apply you get a 30 day under consideration stamp and you could travel outside the country during that time IF you got a re-entry permit and IF you were back before that stamp ran out.

My advice, sit tight the 3 months it'll take to get the Non-O visa, and then the year extension THEN get a re-entry permit (which will be good for a year) and travel all you want
