Can I get leniency for one day overstay on my Non-O visa in Thailand?

Just looking for a piece of advice . I made a slight cock up of my departure from BKK next March. I have a Non O visa (marriage) and with an extension I will be 1 day over on departure.

In all the decades I have visited here I have never overstayed.

I will be going for my extension next month. Is it possible that Immigration could allow me that extra day?

TLDR : Answer Summary
The user inquires about the possibility of getting an extra day allowed by Immigration before departing Thailand on a Non O visa (marriage). They express concern about being one day over their visa expiration and seek advice on their options. The community responds with differing perspectives: some suggest changing the flight to avoid overstay, while others inform that Immigration typically does not grant extensions beyond what is official, although there may be leniency for minor overstays. Suggestions range from applying for an extension, re-entering Thailand after exiting briefly, to checking with airport immigration. Overall, advice leans towards taking precautions to avoid any immigration issues.

Is going to the airport early and checking in the day before an option? Depending on the time you fly out, that may not be so bad.

I called airport immigration because I have friends in a similar situation and asked about overstays. Immigration told us that an overstay of up to 24 hours is not counted as an overstay and no fine needs to be paid at the airport.

My friends already traveled about 8 hours after their stamp expired and they did not pay anything. However, I am not sure how this will be recorded or counted for future visa applications.

It’s best to call the airport immigration office directly and ask, to be sure.

I reckon JF doesn't have a 1-year extension. He seems to visit his Thai wife on a 90 days Non-O Family visa, and then extends for 60 days based on "family visit". Thus getting 5 months of stay outta it. And now he is one day short . . we need more detail, without him telling us what kind of visa or extension he is on, we can't give him proper advice

Check this alternative, that does not include the application to the “60-days visit family“ extension:

*** exit Thailand shortly before the 90-days stay permit out of your Non-Imm-O visa expires.

*** Spend a nice holiday of a few days/ one week in a neighbouring country . . like going to Luang Prabang, or fly to Penang or Langkawi or to Da Nang Vietnam. Take your darling with you

*** when you fly and re-enter visa-exempt back into Thailand, your return flight is the perfect onward travel proof, and you will get stamped in for 60 days. You won’t have any overstay

so, what are you on? Are you still on the 90 days from a Non-O Married visa, or are you already on the 1-year extension of the stay permit based on being married to a Thai wife? If the first, do you want to extend with 60-days family visit extension? If yes, will this result in a one day overstay? It seems many readers are confused by your question

You can apply for another 12 month extension up to 45 days before you depart. What is the problem?

if Robin was right, he calls the 1-year extension a "Non-O marriage visa" - and this is complete rubbish. If Robin was right pointing him to the 1-year extension of stay permit, then why would he be in a one-day overstay after 365 days of the EoS? Complete and utter nonsense

as married to a Thai wife, you can add a 60-days "family visit" extension on top of those 90 days, no problem. But only once per entry

Most people here buy flights at rock bottom prices, no changes, no refunds. Lose it and buy new ticket.

What time is your flight? Is it possible to stay at the airport past immigration before 12am of the last day of your departure? It'd be the best option if you could wait there/the flight is in the morning.

I'm a little confused. Which extension are you applying for? They will 100% not add an extra day for you, so you can forget about that option. But it's hard to say what options you might have because your post is confusing and doesn't include enough information like when you entered, when your entry stamp went until, what extension you are applying for and when it will go until.

I will get a 60 day extension which runs out in March.

You answered my question in your second sentence. Thank you

there are a few options if you'll actually run out a day early.

1) depending on your flight time, you can try checking in early and crossing through passport control before midnight

2) you can go 2-3 days before your extension expires and see if they'll accept an extension application that you don't qualify for. If they accept the application, they'll give you a 7-day "extension denied" stamp starting from the day of application.

3) overstay one day. There's no fine for one day overstay if leaving from an airport.

you can, but you'll need a lot of paperwork and proof of 400,000 in your Thai bank account for 2 months
