Will I receive an overstay stamp if I bounce out a day after my new permitted to stay date?

Good morning. Please could I ask a quick question to Admin: I am going to immigration this morning to cancel my Non B, extension of stay and work permit ( boty currently stamped until Jan 2024) My understanding is they will give me a new permitted to stay stamp to correspond with the end of my contract ( 31 July 2023) . My intension is to border bounce to gain a 30 day exempt then apply for a Non - O based on being over 50. Now, as I already have a multi entry re-entry permit in my passport ( valid until Jan 2024), my intention is to bounce in - out on 1st August to avoid them stamping me back in on the original Non - O extension. My question is: will I recieve an overstay stamp, as I'm bouncing a day after my new permitted to stay date, or do I get 24 hrs to leave after 31st July? I am worried I'll get an overstay stamp which will affect my application for the New Non - O based on being over 50. Hope this all makes sense and would appreciate your advices.

TLDR : Answer Summary
The user intends to cancel their Non-B visa and work permit before border bouncing to gain a 30-day visa exemption, then apply for a Non-O visa based on age (over 50). They are concerned about receiving an overstay stamp since they plan to bounce one day after their new permitted stay date. Community members clarify that the cancellation will align with their employment end date, and if exiting by air, a minor overstay would not incur a fine. Additional options for applying for a Non-O extension directly without bouncing were also discussed.

I see that we had messaged back in June about this situation and that you're cancelling an extension from one immigration office and then moving provinces so will be applying at a different immigration office and that's why you want to bounce out and back to start fresh with a 30 day stamp to Non-O to year extension at that new office..

Yes, all absolutely correct. As just mentioned , my funds are not seasoned, hence the bounce. Thanks so much for the clarification.

Now just to further muddy the water, you COULD cancel your current extension of stay based on employment and immediately apply for a NEW yearly extension of stay based on being over 50 (retirement) IF you had the 800K baht in a thai bank account in your name only for 2 months BEFORE you go to cancel your employment extension.

That would eliminate the bounce out and back, apply for the new in country Non-O, wait the under review period, then wait the 2 months and go back to apply for the year extension.

You can CHANGE THE REASON for your extension from employment to retirement without ANY issues at all IF you meet the financial requirements

@Derek ******
makes sense (y) will totally work, cancel the extension, bounce out and back, get a 30 day visa exempt entry, wait for the funds to be seasoned (take the 30 day extension if you need to) and then apply <- make SURE you have enough days left on your current stamp to apply for the in country Non-O at what ever office you're using (some are 15 days some are 21 so check when you get back and get moved)

So I thought there was no seasoning requirement for the initial 90 day Non - O application, only for the yearly extension. Am I wrong in thinking this ?
Ellie *******
@Derek ******
, basically, right. there is no seasoning requirement for application for an initial in-country Non-O visa based on retirement. But depending on the office, there are a few offices that have a seasoning condition for that such as Jomtien. You need to check with your local immigration office for the latest requirements.

@Tod ********
the 700K is not seasoned, hence the bounce.

@Tod ********
also eliminates the need to transfer the 800k from overseas to get the initial 90 day Non-O visa

@John *********
well spotted that getting the year extension does NOT require proof the funds are from abroad (in case his office requires that for the initial Non-O) (y) (y) (y) <- three thumbz up

@John *********
he's using two different offices too, so he'd really have to get his act together to cancel the extension, get to the new office, file a TM30 (maybe a TM28 if they use it) THEN apply for the year extension

This post was declined initially

BUT

it actually reads harder than the process you're trying to do ๐Ÿ™‚

Here's the answers as I see it

Okay let's first break this down in to manageable bits

It works like this, when you cancel your current extension you will get stamped in until the date the termination paperwork says you stop working. SO what ever date that is you need to bounce on or before that date.

IF you are bouncing out and back by air, and the overstay is under 24 hours they won't fine you but they WILL stamp your exit stamp "overstay under 24 hours fine waived"

IF you are bouncing out and back by land, ALL overstays are fined so if you bounce a day after your stamp you get a 500baht fine AND an overstay stamp in your passport

A single day overstay (fined or free) will not affect your in country Non-O visa application in the least.. Bounce out and back come in on a new 30 day visa exempt entry and then apply for the in country 90 day Non-O visa

Sorry for the train wreck ! Ok, thanks for confirming that the re-entry permit will also cancel on the date written on the cancelation paperwork - this will be 31st July 2023. I'll bounce out and in on this date as per your recommendation.

your plan is totally workable, sounds like you planned your work and now need to work your plan.. It can be done, you just have to get your ducks in a row and quacking in time once you get back in on that 30 day stamp ๐Ÿ˜› ๐Ÿ™‚ good luck with it safe travels,
