Who is responsible for registering renters with immigration in Thailand: landlords or tenants?

I have a question regarding not visa, but renting a condo. From what I read and heard from other expats, it's responsibility of apartment owner to register us in immigration office. We were sure that the she did it, but when we asked, it turned out that she didn't.

Now she is trying to tell us that it is our responsibility to register ourselves. We try to convince her that she can have problems, not us, but it doesn't work. Do you know any Thai website where it is explained clearly so we can send her a link (her English is not perfect)? Or maybe we're wrong and this is our responsibility?

Lesson to be learned here is you do not sign a lease without a completed TM 30. My landlord wouldnt do it so I went to immigration paid the 1600 baht fine and took it out of following months rent. She objected until I threatened to call thai tax office complete with copies of the lease and her bank account #.

It also depends which Province you live in. I have friends in Bangkok and couple others where their Immigration Office does not do TM30.

Thai and Farang Landlords Don't want to know about the requirement to report renters - BECAUSE reporting your presence - renting a room, bungalow, apartment, etc. means likely getting found out for not reporting Rental Income for Tax purposes - Also known as Evading Taxes. This failure to report can go back many years and big money to pay - plus fines.

Do you know all the Immigration laws in your own country? I suppose not, so why blame a Thai for not knowing what and how to handle Immigration laws if a foreigner shows up.

It is definitely your land lords responsibility BUT many offices know that land lords won't do it, so when you go in to the immigration office to get an extension or something from them you get fined for it not being done.

Section 38. The householder, the owner or the possessor of a dwelling
