What should I do after my DTV application was rejected by the Hanoi Embassy?

Hi everyone! DTV work action was rejected at Hanoi Embassy.

I submitted my application on the 30.9, got 3 emails asking for further documentation.

Now, in my case I had a non B visa & work permit, all of which was cancelled, expired & company ownership transferred to someone else via the lawyer I worked with.

Provided all the needed documents (bank statement with the funds, company letter, company registration outside Thailand, proof of source of income).

Then they asked for further information about work permit & business registration in Thailand - provided that alongside the proof of transfer of ownership & cancelled work permit.

Yet, it was rejected saying “not eligible for DTV, please apply for non B visa & work permit again.” Which is not the route for me as I don’t have any company anymore in Thailand.

Anyone experienced similar challenge? Any advise?

Going to the embassy tomorrow to ask for clarification…

Thank you!

TLDR : Answer Summary
An expat in Thailand experienced a rejection of their DTV visa application due to past involvement with a non-B visa and work permit, which has since been canceled. Despite providing various documentation to support their application, including evidence of funds and ownership transfer, the embassy deemed them ineligible for the DTV visa, suggesting reapplication for a non-B visa, which is not feasible for the applicant as they no longer have a company in Thailand. The post seeks advice on navigating this situation and finding alternative visa options.

Did you also provide a personal saving bank statements under your name with the ending balance of no less than 500,000 THB or 16,000 USD in the last 3 months? Please note that this is the MAIN requirement of Financial funds from all Thai embassy in Vietnam, Laos, Indonesia, Philipines, and many other countries. If you dont have these amount in the last 3 momths your visa will not get approved.

Looks like they don’t believe your work is generating income solely from outside the country.

How long ago was ownership of the Thai company transferred? When did you cancel your Non-B and work permit? What did you show for your source of income and did it reference the Thai company at all?

as for the income - no reference to Thai company at all. We registered our business in the US in July & showed proof of income from there.

company transferred in July. Work permit cancelled in July. Non B visa expired 2nd of October, applied to new DTV visa right after.

@Claudia *******
that might be your problem. If you were on an extension of stay rather than an actual visa your extension of stay died the moment you cancelled your work permit. So you would have been on overstay from July

Where's your income coming from? The Thai company? Even you don't own it, but it's the source of your income, then that's against the DTV rules.

the Thai company was closed in July. Main source of income is coming from the online business which is registered in the US since July.

So you had two jobs before, one in Thailand and one as a digital nomad? Both at the same time?

Anonymous participant 348 no, we worked online but had the company registered in Thailand as there was no DTV back then available.

- So, you can imagine the red flags that raises with the embassy. You are doing the same job, but prior you needed a work permit for that same job. Now you are trying to tell them you don’t need a work permit for the same job.

You shouldn’t have mentioned it, they’re thinking that you will work physically in Thailand with that Thai company

Apply again but saying you’re a remote worker working online travelling through Asia showing proof of your funds and a letter form the company that employs you saying you can work online etc

But don’t mention the Thai company and work permit

Anonymous participant 786 yeah I think they didn’t like the fact that there was previously a Thai company present. We spoke to an agency now & even though we have all the right papers they recommend us to go the soft power route in our case, applying to the embassy in Laos.

Was the company related? the type of job? Think yourself, would it look weird to you, if someone gives up a perfectly good company and visa, but wants to stay in the same country with a visa that is technically worse, but working online?
