Hi everyone…

I just need some advice… I have a family emergency back in SA and I need to leave either tonight or as soon as possible. I am on an ED-Visa and my husband is dependant on that visa as well he has a Non-O..

However, we went to immigration last week to get it extended and it was put “under consideration” and have to return the 2nd of August for the extension…

If I leave tonight will I be able to come back on the ed-visa or enter as a tourist? Also, he will not be going with me to SA so when he goes to immigration wil he be able to get an extension on the ed-visa knowing that I am not here?

This is quite urgent.

Thanks

TLDR : Answer Summary
The user is seeking urgent advice regarding leaving Thailand due to a family emergency while on an ED-Visa. They are concerned about the implications of leaving before their visa extension is approved on August 2, particularly how a departure will affect their ability to return on the same visa and their husband's dependent status. Recommendations include obtaining a re-entry permit before leaving and clarifying the consequences of overstaying or missing the visa extension process.

can you be out of the country whilst on the 30 day Under Consideration period?

If you have a re-entry permit, yes. And if you have Non-O, after talking with the local immigration office.

IF you do leave and plan to return on or before August 2...get a Re-entry permit at the Airport BEFORE you Pass thru Thai immigration.

As noted ... IF you return after August 2... your visa is gone... and your husband's too...a significant problem.

If you will be back before 2 August, you can enter Thailand on your current stamp/extension if you applied for a re-entry permit before you leave Thailand. But once past 2 August, you cannot enter on your current stamp. You are from SA, you can enter on visa-exempt. But you have to do your Non-ED all over again from scratch.

Your husband cannot do anything regarding dependent visa/extension at the immigration office without the main person's presence.

If you are not coming back until 2 August, he will be on overstaying and need to do all over again with your visa.
