What is the divorce process in Thailand if my spouse wants to divorce me but I do not?

So my marriage scheme doesn't seem to be working out.

The wife wants a divorce and she seems pretty serious.

We're not really talking now and she doesn't seem to want to listen to reason. Suppose that is her prerogative.

What is the process if she wants a divorce and I do not?She has to petition the court?

Will that make problems for me leaving Thailand? I have travel plans next month.

Right. But she/they can't compel me to sign the paperwork, correct? If I choose to contest, she will need to petition the court and that takes awhile, I think. I wonder how long I can drag this out. I liked her, she was a fun person, but horribly jealous and that strained our relationship. I don't care about the marriage I care about the taxes (US citizen). I dumped a lot of money to help her with her dental problems, I would like to recover some of that money. Currently she is on a tear to make my life miserable, I think she'll calm down after a month or two.

If she’s got a lot of money in her name, just tell her you’ll do the divorce in exchange for whatever you think is fair. If she has little to income and/or little to no savings you aren’t going to realistically recover anything.

Also, not sure how it works here, but if you contest it there’s maybe even a chance the courts award payments in her favor. Might be cheapest and most painless to sign whatever it takes it end it asap.

Why on Earth should the private relationship/love (or abscense of it) be the basis for all sorts of legal consequences/entitlements, from tax savings and right of residence (at first) to spousal support, incredible amounts to be paid as a result of divorce settlements (later), etc. Totally crazy. Get a good lawyer and be fair. It won't be easy, but that's life, you'll get through it. Next time pick someone that you know for a long time before marrying. If she pressures you, something is not right. It should be a peaceful happy feeling not pressure and excuses. Two marriages and kids taught me a lot. You'll get through, make a plan and be fair. No problem but check the agreement you sign at the Amphur. There is a section to discuss finance arrangements and there is a box for no financial payment. If you have kids it can be complicated.

Basically she will own any land you have bought and you should agree to share and assets like car etc. Give her the motorbike if you have one. She will also have to choose which name she reverts to maiden or with your permission can keep yours ( good if kids involved). Close any bank accounts sharing proceeds.

Your marriage visa will expire on divorce I believe so you should replace it with another visa.

Married in BKK. Went to US embassy to get freedom to marry letter. If you plan to do the same, get a certified copy of her passport. You don't need it for the marriage but it may come in handy for US Government paperwork.

Please disregard the random advice and check thai law, perhaps with a thai legal team. I believe there's rules over length of time married and if she can push divorce through without your agreement. If she can do that, once divorce granted you will probably need to leave if you are there "based on marriage". . Different rules I believe, for those married for certain amount of years.

you didnt mention what went wrong. if a Thai woman tells you she wants a divorce, she has pretty much thought through it all. They wont change their mind and now you have to protect all your assets which have given zero info about. so no one can guide you on that. if you have built a house, purchased vehicles, taken a loan, have joint accounts, all of those things will get in the picture before and during the divorce. but we cant advise as we dunno anything. i hope it does not turn messy

If she really wants the divorce and she's not just throwing a tantrum then set a date with her to go down to the local district office and give it to her. At the end of the day it's her choice and her right. Especially if you have no dispute over assets. It's a super simple process if you both agree. If you are currently on a non-O visa based on marriage technically it should be cancelled 24 hours after the divorce. But the systems aren't linked and the responsibility is on you to cancel the visa. However as with anything in life there's a grey area and I'm speaking from experience "I had a friend". If you don't report it you can just let your visa run it's natural course and then get a new one. My last point and it's non of my business. But if she doesn't want you then you really should move on and find someone who actually wants to be with you. It's not as if there's a lack of choice

If there are no kids between you both, and no major assets bought while married, then it is very simple to get divorced at the local Amphur.

She can only go to court and divorce you without you being there if she can proove that she hasnt seen or heard from you in a certain amount of time.

If she wants a divorce, just divorce here. "Reasoning" isn't a culture thing in Thailand. Once Thai ppl are done with you, they are done with you.

Just so you know if you arent in the same house at the moment be prepared that she can come in and take anything she likes from you as you are still married.

i dont like to stereotype, but from over 25 years of living in thailand and being married to a thai person, that their emotions are like glass...once you break that glass there is no putting it back.
