What are the steps to change from a Non-O visa based on marriage to a Non-O visa based on my Thai son after divorce?

Hi Guys.

I have had a non O based on marriage Multiple entry from Savanakhet in Laos. I have renewed it for several years.

I have also a son from the marriage he is 9.

Sadly the marriage is coming to an end

My son wants to live with me here in Thailand.

I am English.

When the divorce is finalized. How long do I have before I need to notify and I want to change from marriage to dependent, my Thai son. Is this possible.

For now all is fairly friendly between me and my wife.

Any help will be appreciated.

Also remember, you can only get a 90 day single entry Non-O based on raising a half thai child at Vientiane and Savannakhet. They do NOT offer the year long, multi-entry Non-O for that reason.

That means you get that visa and then meet the financial requirements to get an in country yearly extension (400K baht in a thai bank account in your name only when you apply for the extension) OR you just get 90 day single entry Non-O's, then extend for 60 days based on visiting family, then when that runs out go get a new 90 day Non-O.

You can get a year-long, multi-entry Non-O's based on raising half thai children in Penang Malaysia BUT they also require proof of 400K baht in a bank account (although you can show that in a foreign account).

I would say BEFORE you get divorced, run to Savannakhet one last time and get a NEW year long, multi-entry Non-O visa based on marriage. (true it might not be in the spirit of the law BUT it follows the letter of the law and that would be as long as you're married WHEN you apply for the visa you can get it).

That would give you 15 months (in 90 day increments) to sort things out visa/extension wise as far as raising a half thai child.

officially you can only get a NEW visa in your passport when there is no valid visa or valid Extension of Stay with Re-Entry Permit left in your passport. But some Thai consulates staff are lenient and give you a new visa in the last days of your old.

IF you are getting year long, multi-entry Non-O visas from Savannakhet every year you're NOT renewing ANYTHING. You're buying NEW visas each time.

The way a VISA works is even if the reason you got the visa changes you are allowed to stay for the validity of the visa. <- Meaning even if you get divorced you can still stay on this visa (90 days at a time) until it runs out.

IF you were on a yearly extension from the immigration office then the second you signed the divorce decree you would have to cancel your extension..

Multiple entry visa is valid as it is, as already described above. You have multiple entry visa, you have no reason to report divorce to the immigration office, no way to report in official manner regarding your visa only (..not other official business).

If your son was born after you got married legally or you have parent right if he was born after you got married, you will be able to get multiple entry non-o based on half thai child next time you apply for the visa, you may need some papers from your (ex-)wife.

If you're on a valid multiple entry non-o visa based on marriage, you can get an extension of stay based on being a father of a child no later then when your last exit stamp stamp. Your visa is still valid, and you are free to continue using it until it expires.

If things do go sour with your ex-wife and she threatens to cancel the visa, just nod and smile. Nobody can cancel that visa.
