so.

If a fellow gets married, gets a marriage visa, gets a divorce, what happens with their marriage visa? Do they have to leave the country 3 days after the divorce is final.

Also, does he have to consent to the divorce?

TLDR : Answer Summary
In Thailand, if a person holding a marriage visa (typically an extension based on marriage) gets divorced, the visa becomes null and void immediately upon the finalization of the divorce. This means they would have to leave the country on the same day, with no grace period to remain. In some cases, individuals may face daily fines if they do not leave. As for consent to the divorce, it appears that if one does not consent, they may still be considered legally married, allowing them to remain in the country until their current visa expires. It is advisable to seek legal counsel for specific situations, especially concerning renewals or future visa applications.

Can anyone recommend a visa agent for marriage visa in Hua Hin please?

This is the main reason a Thai woman does not have to change her last name when she gets married to a foreigner. So she doesn't have to go through the court procedure to change it back when they divorce.

My advice. If you are going to get divorced leave the country and get a 60 day tourist visa. Then come back in and get your divorce. You then have the balance of 60 days to decide what you want to do.

The marriage visa is then null and void, as you are no longer married. Look for other options.

Nobody divorces you if you don't want and if you are not a victim as some "guys"...

Dude that is rough. I am in this group because its difficult to get kicked out, but people really don't like you. That is impressive.

Wow. Conceited or what. From your profile you seem to run or are involved in some form of pet sanctuary. A guess is that you solicit funds to help with this project at some point. You certainly aren’t doing you or your service any favours on this thread. You demean Thai women and label them all as hookers. You laugh at people trying to help and you love your own replies. Perhaps time to move on to another group where they won’t see you as such a patronising piece of human waste.

Thank you for your input. You “laughed” at other responses, liked two and loved your own unintelligible response. Keep up the good work.

If he wants to stay the length of his visa tell him not to consent every time he gets a visit or a letter .

A mate of mine is in the same boat with his wife

It's been going on for months, and he's still here .

If he doesn't consent he is still legally married and allowed to stay in the kingdom to visa runs out

You must have the reason for the extension present at the time of renewal. If that’s based on marriage then the wife must be there. If it’s at a contentious divorce state then that probably isn’t going to happen.

@Terary *********
as far as I know but don't hold me to that .

His renewal time hasn't come yet but it must be due.

If it's not on the system that he's going through a divorce can't see why not .

If he's got all documents

'If it's not on the system' With all the paperwork required, and not electronic, he is not likely in the system.

I wonder if I just moved some other place and just not told her where, if I could stay indefinitely.
Chris *********************
@Terary *********
you start off saying asking for a friend.

Then you say if I move somewhere and not tell her.

Be honest with people and they will be happy to help

I said nothing about 'for a friend' and I am, not only, a fellow, but the fellow. Also, its just a hypothetical question.

No lady in her right mind would ever leave me Bahahaha

The cycle of Thai-Western marriage. Was this the union of a young Thai women and older Western man.

You have to leave the country same day you got divorced. Or you pay 500Baht fine a day until you can change to another visa etc.

Might be time to get a lawyer, I did
Stuart *********
If they are on an extension of stay based on marriage then that extension is null and void on the same day the divorce is finalised. They would have to leave that day, if they don’t have a different reason to change their extension to. There is no 3 day grace period.

Sorry I don’t know the legalities of consent. I’ll leave others who may know to reply.

I read a story about a farang guy and thai wife. She wanted a divorce and he wouldn't agree. She hired a hit man and the guy ended up in the hospital. The 3 culprits, wife, hit man, and wife's best friend ended up in jail.

But there may have been more to the story, like division of assets or something.
