What do I need to change my retirement visa to a Non-Immigrant B visa in Thailand?

Hi all

I am in need of some advice and getting mixed conflicting info from google etc.

I am here in Thailand on a retirement visa and have my company registered with my thai partner for 4 million baht. I am in the process of organising my work permit through a lawyer but I am told I need to change to a B visa and to do this I need to leave the country?

If this is the case what do I need to bring and what is the process to get the B visa?

Any help is appreciated.

One thing I will say is BEFORE you wing your way to a thai consulate to by a Non-Immigrant Type B visa make sure you cancel your extension of stay based on being over 50 (retirement) at the immigration office. THEN go out and get the Non-B.

You have to cancel extensions of stays not just exit the country on one without a re-entry permit.

those are the requirements to get a VISA from a thai consulate in another country NOT for getting the visa or the yearly extension of stay from the thai immigration office.

The MFA controls all the thai consulates (which are coincidentally outside the country) and they sell visas to foreigners.

The Royal Thai Police control all the immigration offices (which are coincidentally inside the country) and they sell visas and extensions to foreigners in thailand.

Okay, recommendations are written behind every requirement [between brackets] 1. Recommendation letter from the employer addressed to the Embassy (stating about

the employment and visa application) and be accompanied with the certified copy of the endorser's ID [This is written by your business partner]

2. Employment contract [Made by your business partner]

3. Form of the Employment Certification (Download Here) [Fill in owner/share holder of the company]

4. Approval Letter from the Ministry of Labour of Thailand

or Copy of the current work permit [This is the WP3 confirmation letter you got from Ministry of Labor]

5. Copy of corporate documents, namely;

- company registration certificate

- list of company shareholders

- memorandum of companyโ€™s regulation

- latest income tax statement

- latest registration of value added tax

- the name list of current foreign employees [just get these copies]

You need to change to Non Immigrant B. You or your partner visit the Ministry of Labor, ask the hand out needed to apply for the Work Permit using the WP 3 application method. You copy all the papers needed and file the application. If all correct than you get a WP 3 application successfully applied. This paper and other company papers you need for the Non Immigrant B visa, you can look at the website of the Consulate-Embassy you're going to visit what the requirements are.

I worked here 12 years, never used an agent for myself or for any other staff member in our company, and I use the same offices as you and your known business owners. This for Work Permits and Visa's. I guess that's made me an unpaid Visa Agent.

- Robert I disagree the evidence piles up every week here on this Group. Many many prople cannot do a Work Permit and B Visa without paid help. I personally know about 12 'business owners' here in Krabi that use a vsa consultant year after year - not just the first time.

The WP Application is Not Not done until the OP or his lawyer collects the stamped Successful WP.3 Application and the official Labor Ministry Transmittal form letter rewuired to be used in the B Visa Application file.

Also as I understand the Group rule it is to not recommend a consultant by Name. I do not know of any prohibition about merely suggesting that a consultant is needed.

He is in the process of application of the Non Immigrant B visa. The application for the Work Permit as more times mentioned is DONE and the WP can be collected in several weeks.

As you are currently on a One Year Extension of a Non Immigrant O Visa (oftened nicknamed 'Retirement Visa').

Under what I consider antiquated rules you must apply for a Work Permit and the B Visa (Business) using the WP.3 Work Permit Applicatiion Form. If you did not use the WP.3 Application I do not see the WP being issued until you do considering your Visa Status.

This process will require you to leave Thailand - go to another country such as Laos or Malaysia - then apply for the B Visa at a Thai Embassy/Consulate there. When you leave Thailand you go without a Reentry Permit effectively cancelling the Non O Extension of Stay. At this time you would have no active Thailand Visa status.

Some Labor Ministries require proof you exited Thailand (photos of Exit Stamps and Entrance Stamps) before they will release a WP.3 Application form stamped 'Successful Application). At the same time or a few days later the Labor Ministry will release a form letter stating that the WP.3 Application was successfully submitted. Both these documents have to be included in your B Visa Application. Some Labor Ministry offices release both documents same day - some without proof you have excited Thailand.

Note: Neither the WP and B-Visa application process nor documentation differentiates between Employee or 'owner'. You become a Shareholder and later Director.

The list of required documents for the B Visa is as mentioned available on line at the Embassy / Consulate you plan to go to.

Hany Saad - The WP and B Visa are intertwined for you because of your starting Visa Status. You can apply for the WP but it will not be issued until you get the B Visa.

I thought that the company registration and wp were the hard part and that the B visa was the easy quick border hop part but it seems that's not the case ๐Ÿ˜ž

Joe D Greene my understanding though is that the status of the wp is not relevant to obtaining a B visa as the B visa is arranged by most people before they apply for a wp?

It's just in my case I did it backwards and applied for wp first and now have to get my visa changed

I only mentioned the requirement of application of the Non Immigrant B visa at Vientiane Consulate. This because his WP is filed successfully already.

Hany Saad - I just went through this process late last year under the same Visa status as you. I am just relating what I had to do - the process and sequence I had to go through. Please just consider that maybe you don't have full 100% accurate information as to what is going on with your WP Application. It could be sitting there on the desk of an officer of the Labor Ministry waiting for documentation of the things Robert has mention and that I will post next.

Yes, but you need first the Non Immigrant B visa to collect the WP, with your Extension of Stay you won't get it.

As already mentioned I have already applied for the work permit. That is in process but I now need to know what the process is for getting the non imm B visa.

There are 4 kinds of Visa and an Extension of Stay all named retirement visa by expats. They all have different rules and regulations. It is impossible to give correct advice if the type of visa or Extension is unknown as you already found out by using google to get conflicting information.
