TLDR : Answer Summary
The statement that a 60-day tourist visa cannot be converted to a marriage visa in Thailand is false. Multiple comments confirm that it is possible to transition from a tourist visa to a Non-Immigrant O (marriage) visa, provided that all requirements are met. Some users shared their successful experiences of changing visa types and highlighted the importance of having sufficient time left on the tourist visa and the necessary documentation. Thus, with proper preparation and understanding of immigration rules, individuals on a tourist visa can indeed apply for a marriage visa.

You can.

The process is called „change of visa type” and it is done on Immigration inside Thailand.

When you enter on the single entry 60 days tourist visa, first off you should open a Thai bank account in your sole name. Many banks won’t open one on a tourist visa, so it is faster if you use an agent.

Then wire a transfer of a minimum of 400.000.- THB to your bank account. Once the deposit sits there, get your bankbook and a fresh ATM receipt of a small sum of money, and visit Immigration.

Apply for the change of visa type from the Tourist Visa to a “90-Days Non-Imm-O family Visa”. There is no seasoning of the 400.000.- THB needed at this point. The fee for the application is 2000.- THB

Why this? Most Immigrations however require a proof that the funds came from abroad. This is very immigration specific.

The Immigration in Jomtien is known for making up their own rules – one of these being that the 400.000.- THB need to have seasoned for 2 month for the application to the initial 90 days visa!

But most other Immigrations only want to see the money in your account. The two months seasoning will be required when you apply for the 1-year extension of stay permit, from up to 30 days before the 90 days of the Non-Imm-O visa expire.

The Non-O visa will first get issued for 14 days “under consideration”. That’s why you need a minimum of 15 workdays left on your stay permit on the day you apply for the change. After the 14 days, visit Immigration and pick up the 90-days visa stamp.

Once you are only 30 days away from the expiration of the 90 days stay permit, and the 400.000.- THB have seasoned in your account for minimum of two months, you can apply for the “1-year extension of stay permit based on marriage to a Thai wife” The fee for this application is 1900.- THB

Your “1-year family Extension” will be issued “4 weeks under consideration”. During this period, Immigration will visit you at home, take pictures and ask your neighbors if they think that you are really married. Smile at everything and offer them some coffee or tea!

After the four weeks, visit Immigration and pick up your one-year extension stamp.

I included the .pdf of the Immigration website, listing the requirements for a “change” from the tourist visa to a “90-days Non-Imm-O family visa”

NOTE: do not travel out of Thailand during the two “under consideration” periods

NOTE 2: when issued the Extension of the Stay Permit, buy a re-entry permit, so you stay permit stays alive in case you exit Thailand and re-enter within this one-year extension. A single re-entry permit is 1000.- THB, a multi re-entry permit is 3800.- THB

so I am on a tourist visa. Money has been in the bank for 6+ months. Maisai said that I could not convert tourist visa. Chiang Rai called and spoke to the lady who told us that and she said it was because I had an Ed visa 2 years ago. I am at an absolute fucking loss as to what to do other than roll the dice at Svannakhet doesn't mess with me- but as I've said I am so JADED about it I am considering just getting a new passport and then trying again.

and the third option is: gather up your Thai wife and get a freshly printed "Kor Ror 22'" from the Amphur (the marriage registry printout). Take your bankbook and visit the consulate Savannakhet. Financial proof is required since last year. You are free to decide if you want to apply for the multi entry, or the single entry Non-Imm-O marriage visa. From either of these you can convert to the 1-year Extension of Stay based on being married to a Thai wife. Savannakhet is a walk-in place. Hand in pre-filled forms by the morning (avoid mondays!) and pick up in the afternoon the next day. If you want multi entry, write that into the right upper corner of the application form, because if you don't do so, they will issue a single entry Non-O. Multi entry Non-O is 5000.- THB fee, the single entry should be (??) 2000.- THB

I know the information will still be in the system. But they seem to enjoy flipping through the book and freaking out about this, but don't seem to do much surfing through the data on the computer and this isn't an official rule-rule like Multi entry or single or extensions are X days. It's not a "this gets auto filled by the system" thing - it's within the culture of the department they've been told to shit on people who did this, it's like racism in the USA in the 70s. It still might not help- but if I potentially need to leave the country for my renewals it might be worth trying. Might also need to investigate the agent route... I just hate the idea that "other people skirted the system so they bully me so I now skirt the system" I want to be part of things being better not feed into them being broken.

Greg do you know if it is true that you cannot get the non O through the website? Svannakhet is easier than accessing the embassy in my country.

@Jack ***************
the multi entry Non-Imm-O family is not mentioned on their website, but in Savannakhet you can definitely get it. You need to ask directly

Getting a new passport won't cut the ice. All your data are in the central computer file. Every Immigration officer can see it with the click of the mouse when he/she enters your name and birth date

I reckon that on other Immigrations inside Thailand, you will run into the same problem – your previous stays and the previous ED visa just don’t sit well for doing a “change of visa type”.

So, there are two options left:

*** Try your luck on a Thai embassy or consulate in a neighboring country and apply for the 90-days Non-Imm-O visa directly. Since you can already fulfill the financial requirement for an extension of stay, so it does for the application to the 90-days visa.

And then in Thailand on Immigration apply for the 1-year extension of stay when the 90 days have run down to 30 days left

*** Fly back home and apply for the 90-days Non-Imm- O visa in your home country
Kool *******
It depends on how many days you have left on your entry stamp.
Oleg ***********
@Kool ******
minimum 15 days. For the first NON O FAMILY, extension can do with overstay up to 15 days, if pay overstay of course.
Oleg ***********
@Greg **********
sure can. 90 days visa retirement or other cannot, need minimum 15 days. Extension can do..
Greg ***********
@Oleg **********
when issued the 90-days Non-O, it starts on the day it gets issued. From this day on, after 60 days (in some places 45 days) you can apply for the Extension of stay. This means you have THREE months in total to get your 1-year extension of stay. It's impossible to run into any overstay unless you are a complete nutcase
Greg ***********
@Oleg **********
how would you slip into overstay in the first place, when doing the "change" from the TR visa to the 90-days Non-O retirement visa, and from up to 30 days before the 90 days expire, to the 1-year extension of stay? You would be incredibly dvmb to allow yourself run into an overstay. You got plenty of time - 30 days and in some places even 45 days - to apply for the extension
Greg ***********
@Oleg **********
anyone on overstay, cannot apply for the initial 90-days visa. This is highlighted on the Immigration .pdf of the requirements to the "change of visa type". I have never heard of anyone getting issued a 1-year extension while being on an overstay, no matter how long !

If the marriage is real, there’s a lot of steps you need to take in order to get a marriage visa so start taking pictures and start keeping Texas and emails between you too

primarily I want it because I travel to the USA every couple of months for a project and I've been bombarded by rumormongering that "Thailand is cracking down" and I'll get turned away at the border when returning. Mostly I think this only happens to gross abusers- except I had a immigration lady yell at me in the airport once- this was crazy- she clearly didn't want to let me on, called a supervisor, he said it was fine so she stamped me and then yelled "next time don't stay so long!" It was bonkers.

Anyway, so I now know there are some crackpots in positions of power and so I want some protection against that sort of thing.

, I am waiting to get my one year extension approved next month, my question is if I went back to US in 4 months and come back before the extension expires, is it the same process to get another year of extension?
Phil ******
@Jack ***************
nope you need this time plus a 30 day extension
Jack ****************
ORIGINAL POSTER
@Phil *****
well that is absolutely not the case and the common repeating of that just wasted 2 months for me. You need 14 days left, but you can apply for the marriage visa the day you arrive if you want.
Phil ******
@Jack ***************
so this guy had 90 days

you said "you need this time (60 day) plus the 30 day extension" and believing that I planned my trip so I would apply once I got my 30 day extension. But it is not true. You can apply the first day and it only takes 2 weeks.

repeating of what ?

which office as 90 days is more than sufficient for the non o EXTENSION based on marriage

Even the thai embassies advise 90 days this is from South Africa.

False. Providing you meet the requirements you can apply for a Non Imm O visa whilst on a Tourist visa.

I went from a 60 day tourist visa, to a medical visa, to a marriage visa. Not a problem if you meet all the requirements. This is my 7th year in Chiangmai on a marriage visa.
