Hello, my question is if I marry my Thai partner in Australia is that proof enough for a marriage visa in Thailand once I arrive non a Non O visa or do you have to have a Thai marriage certificate?
Answer summary
To obtain a marriage visa in Thailand as an expat married to a Thai citizen, it's essential to register your marriage in Thailand. An Australian marriage certificate can initially help you acquire a Non-O visa, but for a one-year extension, you'll need to register your marriage locally (at an Amphur) and ensure your marriage certificate is authenticated, translated, and notarized through the Thai embassy or consulate prior to arriving in Thailand.

Hello Bob,

I am Thai and Hubby is Australian citizen.

We registered our marriage in Perth. Here is what we did in order to obtain the marriage visa for my husband. This is all done in Thailand

1 - had our marriage certificate authenticated with the Australian embassy.

2- Have the authenticated certificate translated by notarized service agent.

3- Go to Aumpur ( District office) for the registration of the marriage. You will need to 2 witnesses for this process. They will hand you the registration on the same day

Keep in mind if you are doing visa renewal, with this registration- you will need to go get a new copy as this must be 60 days validity. Basically just have to go back for a new stamp from district office to prove to immigration that you are still married.

Hope this helps.

For marriage Visa, your marriage has to be registered in Thailand.

That’s a lot of paperwork but no problem to get.

Understand if she is Thai you'll still require a Thai marriage certificate.

You can contact the Australian Consulate once in Thailand and send them your original marriage certificate. Pay $105 AUS to have it notarised. Once you get it back take it to a lawyer and have it translated into Thai.

Both copies will need to be taken to the Immigration when you do your 12 month extension.

Kylie Murphy No need to use a lawyer for translation.. cheaper to use a Thai translation agency.. they can do translation and get it stamped by MoFA etc.. and will also get the original marriage certificate authenticated by your home country

Embassy in Bangkok if you haven't already done this before travelling to Thailand.. the whole process takes 2-3 weeks and can be done without using a lawyer 😉

The 1961 Marriage Act in Australia makes marriage in Australia much simpler than getting married in Thailand. You don't need to get a letter from Australian Embassy to state there is no impediment, you do not need translations and registration at foreign affairs. To get married on Australia, you fill out a document called NO IM. Nomination for intended marriage, a stat Dec or divorce certificate if either party was previously married, no translations needed. After 30 clear days after filling out NOIM you can marry, register marriage at Thai Embassy in Australia and that is it. The Marriage celebrant in Australia can authorise the stat Dec as part of their duties as a Celebrant. I was an authorised celebrant in Australia prior to moving to Thailand

You have to make your Aussie marriage legal in Thailand, which requires visit to Internal Affairs here and your Embassy here to get your passport once again verified. We used a company in Bangkok who did all the visits for us and sent back required certificate letters etc so then.we visited the local Amphur got the info put on file ( took a while).then they issued my wife a letter saying we were married for the immigration side of marriage visa renewal. It didn't matter to the Amphur that we had been married 15 years when arriving here as our first visit to Amphur with NZ marriage cert all translated from.NZ they just said she single in Thailand and documents from NZ could be fake. Think the vompany in Bangkok.vharhed 2500 baht and did a good job.

Get married in thailand if you intend to stay in thailand. Its too much hassle to get married in your countey because you need to translate it, notarise it and get stamped by thai embassy in your country which is very very troublesome. Getting married in thailand just requires you to go to local office with any 2 witness and youre registered! Easy

Abel Ka but then he would not be able to enter on a Non-O and could not open a bank account to deposit the retired funds for the extension without paying an agent

Abel Ka Does not matter where they marry. For the "other country" they have to do all the work you mention, too.

Abel Ka there is a lot more to it than that, I am divorced and have to provide this paperwork certified and translated

Abel Ka you also need the freedom to marry from your Thai embassy or consulate.

Interesting point that you can make your wife beneficiary of your super and if your in pension mode that carries over to her regardless of her residency rights.

Thai marriage may be better at protecting your assets you owned before marriage. Australian divorce laws leave it wide open to give all your money to the lawyers.

Lyn Peel Actually Lyn, in Thai marriage and divorce inThailand, I believe what assets or debts you had before marriage remain with the holder. Assets and debts accrued during marriage are split 50-50.

Luckily for Australia and a couple other countries (e.g. Philippines), the Australian Marriage Certificate can have Legalisation at the Australian Embassy inside Thailand WITHOUT the need for a Legalisation from the Thai Embassy/Thai Consulate inside Australia beforehand before the Final (End of Chain) Legalisation from Thailand MFA at Chaeng Wattana and few other Thailand Passport Offices across Thailand:

CentralWorld, Central Chiang Mai Airport, Central Pattaya, Bluport Hua Hin, Central Phuket, Central Ubon Ratchathani, Songkhla, etc.)

Your Australian Marriage Certificate as being married to a Thai Citizen Wife is definitely enough to get a Single Entry Non–O E–Visa for 90 Days Stay from a Thai Embassy/Thai Consulate outside Thailand, but for a 1 Year Extension of Stay from your local Thai Immigration Office inside Thailand, you need to get Registration of your Foreign (Australian) Marriage Certificate from a local District Office inside Thailand ( คร.22 ) for a local Thai Immigration Office inside Thailand

You will need your marriage certificate translated , notarised and stamped by the Thai embassy in Australia before you get to Thailand

I did that and I still had to get it notarised at the Australian embassy in Thailand and then translated again in Thailand by a Thai translator. It was a waste of time and money getting it translated in Australia.

i agree, I did the same with UK marriage. You also have go to government office in Thailand to get the Thai marriage form KR22.

It is actually possible to do in Thailand, we used a specialist company that sent the UK cert to Thai embassy in UK.

The Thai Embassy needs to verify your marriage certificate (best done before you travel) to allow you to register it in Thailand. The steps/process will be similar to this for a UK marriage :

1. IN THE UK: Marriage certificate legalised by the FCDO in Milton Keynes (2 documents, original and legalised copy))

2. IN THE UK: Marriage Certificate AND the Apostille from the FCDO Translated (2 translations from 1., now 4 documents in total)

3. IN THE UK: Marriage Certificate AND the Apostille from the FCDO AND their translations verified by the Thai Embassy in London (4 verifications from 1. and 2. giving 8 documents in total)

4. IN THAILAND: All the above (i.e. all 4 documents & their translations, making 8 in total) Legalised by MFA in Bangkok

then register your marriage at your local Amphur.
