Before emailing the embassy I thought I would ask here

Does anyone know if a certificate of civil union is accepted as proof of relationship for a spouse DTV?

We are not ‘married’ but on paper a civil union is the same. I also know that some countries don’t recognize it as legal. Is Thailand is?

TLDR : Answer Summary
The acceptance of a certificate of civil union as proof of relationship for a spouse DTV visa in Thailand is subject to the discretion of the issuing Thai embassy. While Thailand does not legally recognize civil unions, embassies may choose to accept such certificates issued by the registrar of marriage, depending on local customs and specific circumstances. It is advisable to directly check with your Thai embassy for their required documentation.

If the certificate of union is issued by the registrar of marriage in your country, it suffices.

: should not be a problem, it already shows the couple is legally married.

This is one of the things that's going to be HIGHLY dependent upon the embassy.

Here is an example: Currently Thailand does not recognize same sex marriage. But there are Thai embassies in countries that do recognize same sex marriage. Some of these embassies will actually issue a non-O visa based on being married to a Thai of the same sex, because it's recognized there. But as soon as that couple gets to Thailand, they cannot apply for an extension based on that visa because Thailand does not recognize the marriage.

Because with the DTV you shouldn't really ever need to engage with immigration, it's very possible that an embassy might accept this. But it's going to be up to the embassy, because they can decide to accept it based on the local customs, or they can decide to reject it based on strict interpretation of Thai law (which does not have civil unions).

The only way to know is going to be to check with your Thai embassy.

thank you. I saw news articles from this year March stating Thailand now does recognize same sex marriage. Is that not in the law yet?

no it is not yet law. It passed both houses of government but still needs to be endorsed by the king. And once that happens (no idea when) it's an additional 120 days until it becomes law.
