Does my daughter need the Thailand Pass and insurance when flying back on a UK passport with an expired Thai passport?

My daughter flys back to Thailand from London in 3 weeks. She was stamped into Heathrow on her uk passport as her Thailand passport date has expired. If she’s Flying back to Thailand using her uk passport will she need to get the thailand pass with insurance etc ? Or still having an expired Thai passport is it ok to fly back without the Thai pass and insurance. Thanks for any advice.

From actual personal experience with my dual Thai-American citizen friend who entered Thailand on her US passport because her Thai had expired it is NOT possible to switch passports in Thailand. She was able to apply for a new Thai passport while in Thailand. She took the new Thai passport to Phuket Immigration and was told she had four options. She could leave Thailand before her permission to stay expired. She could extend her permission to stay based on her visa-exempt entry by 30 days for purposes of tourism. She could apply for a one-year extension of stay for being a returning Thai national. She could leave the country by air and return on her Thai passport. Those were her actual options, not her theoretical options. In my opinion, you are doing a disservice to people who need to know how they will be treated in those circumstances by telling them how you think it should be done rather than how it is actually done.

She can enter with her UK passport and get a new Thai passport in Thailand. No problem. Even if the 30 days are up. You cannot overstay in Thailand as a thai citizen. Regardless if your thai passport is expired or not

my wife entered on her uk as lost her Thai passport when going back to the uk they wanted to fine her said she should have gone to immigration and sort it out cant over stay but have to have paperwork done properly

My point is theoretical. But it could happen..That's why I am certain if you are dual citizen but your original citizenship was thai and you enter Thailand on the wrong passport. They cannot hold you accountable if you did something wrong in the immigration process with your other "identity"

I didn't mention punish, you sound like you want her flogged. of course she can get a new Thai passport inside Thailand but she will remain on her UK passport until such time as she flies out on UK passport and re-enters on her Thai passport and will have to follow the rules for her situation until that time. Theoretically I agree. But as I said as a born Thai citizen born in Thailand you will not face consequences if you gained dual citizenship and entered on the "wrong" passport. Suppose she loses her citizenship while in Thailand? I am certain she will not have to do border run to be considered Thai again.

She couldn't even check out with her "wrong" passport. It's void.

You still don't get my point. Let's say I am a born Thai. I have only thai citizenship as I am thai.

Then later I marry a woman from the US just to get my green card and later get US citizenship.

I get US citizenship on a fake marriage.

Later I enter Thailand on my US passport.

In the meanwhile the US government finds out my marriage is fake and I lose my US citizenship

My US passport I entered Thailand is void.

For now on I only have thai citizenship but I entered on another passport which is no longer legal.

So no extention and nothing for me.

That's why I am certain all the restrictions will not apply to a thai citizen from birth

you have to leave and re-enter to be considered a Thai. But if you enter on a foreign passport you have to go to immigration every year and get 1 year extension for being Thai until you leave and re-enter. Much better to just enter on the expired Thai passport.

Once you are a citizen of any country you cannot overstay and they cannot deport you.

Or will they blacklist your "foreign national identity" and ban you for years because of overstay?

Because this will be for farangs becoming thai citizen in Thailand. They have to leave the country and reenter first to be "considered" Thai.

But this will not apply to a born Thai citizen born in Thailand.

Thai was the first nationality in that case

even if you are a Thai citizen entering on a UK passport means you are basically a foreigner but with different treatment to other foreigners. There are immigration restrictions such as having to obtain annual extension. To change to a Thai passport she would have to leave the country on the UK passport and re-enter on a Thai passport. Much simpler to just leave UK on UK passport and enter Thailand on a Thai passport.

I just said I am sure there are no major consequences if she enters on her UK passport and renews her thai passport in Thailand and the restrictiond will not apply to her since she can prove she is Thai already

she can't change passports inside Thailand. She would be on the UK passport until such time as she left Thailand (by air as you can't switch passport any other way) and re-entered on her Thai passport. While inside Thailand on a UK passport she would have to get an extension of stay each year from immigration. See #29 on the list in the link, it's not as simple as you are trying to imply.

Of course she can get s new thai passport in Thailand. Regardless on what passport she entered.

Theoretically the restrictions apply to her. I am just saying I am sure she will not face any consequences if she enters on her UK passport and get a new Thai passport inside the country. Once she got her new Thai passport she will not have to leave as they cannot punish her thai identity for what her UK identity did wrong in the immigration process.

From July 1st:

1) TP will no longer be required for foreigners entering Thailand.

2) Those entering Thailand will be required to show proof that they're vaccinated or a negative ATK or pro-ATK test result. No covid insurance required.

3) Mask wearing outdoor will no longer be mandatory excepts in crowded places.
