I have a couple questions regarding Usufructs. Already have one which has been duly registered at the provincial land office, but I’m wondering whether it should also be registered with any other government agencies?
Two things prompted this question. First, I encountered another farang who told me that once you have the usufruct, you can get a blue house book instead of the yellow one. He hadn’t actually done that, but he swore it was true. I’m a bit skeptical, because I’ve always heard that the blue ones are only for Thai citizens, but I’m also curious whether any farangs out there have actually got their name in a blue house book and if so is there any advantage/disadvantage?
The second thing, occurred yesterday when I was extending my permit to stay in Thailand for another year. Immigration asked my wife to fill out a form that granted me permission to stay in her home. Sorry, didn’t notice the form number but my guess would be maybe a TM 30. Anyway, the extension was approved once she completed and signed the form, but afterwards I began to think that with our usufruct in place, that permission was a bit unnecessary, but much easier to fill out the form than going home to gather and copy the usufruct paperwork. Now, I’m wondering whether I should register the usufruct with immigration or leave it alone until such time that it might be required, which could potentially be never. Would appreciate any insight from anyone who has actually needed to use the provisions of a usufruct.
