Getting a retirement Visa. I see a requirement for a letter of verification of no criminal record . American consulate will not provide. If I apply while here it seems like a big hassle to get out of states ( FBI) . Does immigration here really require if I apply while in Chiang Mai . Other requirements not an issue .

You are confusing the requirements to get a Non-Immigrant Type O-A visa from a thai consulate in the US with what is required to go from a tourist visa to first a Non-Immigrant Type O <- (note there is not an A after that) and then to a yearly extension based on being over 50 (retirement).
It's not a requirement for conversion into Non O based on retirement, be aware that you need at least 15 days left on your admitted to stay period to apply.
